Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Orthopaedic Surgeon
Verify your ECFMG credentials match your petition
Your ECFMG certification, state medical license, and board eligibility documentation must align with the specialty listed on your I-129. Discrepancies between your credentials and the H-1B petition are a common RFE trigger for surgical roles.
Target hospitals filing LCAs for surgeons
Use the OFLC Wage Search to filter Labor Condition Applications by SOC code 29-1067 for surgeons. This shows which hospitals and health systems have actively sponsored orthopaedic roles, saving you time before outreach.
Use Migrate Mate to find verified H-1B sponsors
Search Migrate Mate for orthopaedic surgeon roles filtered by employers with confirmed H-1B LCA filing history. This surfaces health systems and surgical groups that have already navigated the sponsorship process for this specialty.
Negotiate premium processing into your offer
Ask the employer to include USCIS premium processing in the offer letter before signing. Surgical start dates are typically tied to credentialing timelines, and premium processing gives both sides a 15-business-day adjudication window to plan around.
Clarify the cap-exempt status of your employer
Hospitals affiliated with a university, nonprofit research institution, or government entity may qualify as cap-exempt, meaning your H-1B can be filed outside the annual lottery. Confirm this directly with HR before the April registration window.
Align your start date with hospital credentialing
Hospital credentialing for surgical privileges takes 60 to 120 days and runs parallel to H-1B processing. Confirm with your employer that the H-1B requested start date accounts for both USCIS processing and internal credentialing before the petition is filed.

Find Orthopaedic Surgeon JobsOrthopaedic Surgeon H-1B Visa: Frequently Asked Questions
Does an orthopaedic surgeon role qualify as a specialty occupation for H-1B purposes?
Yes. Orthopaedic surgery requires a medical degree, surgical residency, and typically fellowship training in a specific subspecialty, satisfying USCIS's requirement that the role normally require at least a bachelor's degree in a directly related field. The specialty occupation standard is straightforward for board-eligible and board-certified orthopaedic surgeons.
Which types of employers sponsor H-1B visas for orthopaedic surgeons?
Academic medical centers, large hospital systems, and multispecialty surgical groups are the most active H-1B sponsors for orthopaedic surgeons. Nonprofit hospitals affiliated with universities may qualify as cap-exempt employers, allowing filings outside the annual lottery. Private practice groups can also sponsor but must register in the H-1B lottery like any other cap-subject employer. You can filter by employer type on Migrate Mate.
How does the H-1B lottery affect orthopaedic surgeon hiring timelines?
If your employer is cap-subject, your H-1B registration must be submitted in March for an October 1 start date. Fellowship completion dates rarely align with this window, which is why many orthopaedic surgeons target cap-exempt hospital employers or negotiate a delayed start while awaiting the next lottery cycle or a cap-gap extension.
What prevailing wage level typically applies to sponsored orthopaedic surgeon positions?
Most H-1B petitions for orthopaedic surgeons are filed at DOL wage Level II or Level III, reflecting the subspecialty training and independent surgical judgment the role requires. Your employer establishes the prevailing wage through the OFLC Wage Search before filing the Labor Condition Application, and your offered compensation must meet or exceed that figure.
Can an orthopaedic surgeon switch H-1B employers mid-status?
Yes, through H-1B portability under AC21. Once your initial petition has been approved and you've worked for the sponsoring employer for at least 180 days, you can begin work with a new employer as soon as that employer files a transfer petition, without waiting for approval. Surgical credentialing at the new facility runs concurrently with USCIS processing.
