Get Access To All JobsTips for Finding H-1B Visa Sponsorship in Paralegal Instructor
Verify your specialty occupation classification early
Pull the O*NET profile for Postsecondary Teachers, Legal and check that your specific duties require a bachelor's degree or higher in a related field. USCIS scrutinizes instructor roles more than clinical or technical ones, so document the academic requirement explicitly.
Target institutions with existing H-1B filing history
Use Migrate Mate to filter Paralegal Instructor openings by employers with verified LCA filing history. Community colleges and law school continuing-education departments that have sponsored foreign national faculty before move through the process faster.
Request the LCA wage level in writing before signing
Before accepting an offer, ask HR which DOL wage level they intend to certify. Paralegal Instructor roles are frequently filed at Level I or II, which can affect your salary and future portability. Confirm the prevailing wage against the OFLC Wage Search for your metro area.
Align your transcripts to the legal curriculum you'll teach
If your degree is in law, political science, or a related discipline rather than paralegal studies specifically, prepare a credential evaluation that maps your coursework to the instructional content. USCIS often issues RFEs when the degree field and teaching subject aren't an obvious match.
Clarify adjunct versus full-time status with the employer
H-1B requires a bona fide employer-employee relationship, which adjunct contracts often fail to establish clearly. Full-time faculty lines or contracts specifying minimum hours, benefits eligibility, and supervisory oversight are far easier for the employer's attorney to defend in the petition.
Use cap-exempt institutions to bypass the lottery
Nonprofit colleges and universities are cap-exempt under INA section 214(g)(5)(A), meaning your petition files directly with USCIS without waiting for the April lottery. Confirm the institution's cap-exempt status before the offer stage so your start date isn't delayed by a year.

Find Paralegal Instructor JobsParalegal Instructor H-1B Visa: Frequently Asked Questions
Does a Paralegal Instructor role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position genuinely requires a bachelor's degree or higher in a specific field such as law, legal studies, or paralegal education. USCIS evaluates each petition on its own facts, so the job description must clearly state that a specialized degree is a minimum requirement, not merely preferred. Generic instructor postings that accept any bachelor's degree carry a higher risk of receiving an RFE.
Which employers typically sponsor H-1B visas for Paralegal Instructor positions?
Community colleges, four-year universities with paralegal programs, ABA-approved law schools, and proprietary career colleges are the most common sponsors. Nonprofit educational institutions often have an advantage because they qualify as cap-exempt employers, allowing them to file H-1B petitions year-round without subjecting candidates to the annual lottery. Use Migrate Mate to browse openings filtered by employers with confirmed LCA filing history in this role category.
How does the H-1B cap exemption work for college and university employers?
Institutions of higher education as defined by the Higher Education Act, and related nonprofit entities, are exempt from the 65,000 regular-cap and 20,000 master's-cap limits. A petition filed by a cap-exempt employer can be submitted at any time during the year and takes effect as soon as USCIS approves it, rather than waiting for an October 1 start date. Confirm the employer's cap-exempt status with USCIS before accepting the offer.
What SOC code and prevailing wage level applies to Paralegal Instructor roles?
Most Paralegal Instructor positions are filed under SOC code 25-1112, Postsecondary Teachers, Legal. The employer must certify a wage at least equal to the DOL prevailing wage for that occupation in the relevant metropolitan area. You can verify the applicable wage using the OFLC Wage Search before finalizing your offer negotiation, and request that HR document which level they intend to certify in your LCA.
Can I switch from an F-1 OPT to H-1B status while teaching as a paralegal instructor?
Yes. If your employer files an H-1B petition before your OPT authorization expires and you're selected in the cap or qualify through a cap-exempt institution, cap-gap protection extends your F-1 status and work authorization through September 30 of the same fiscal year. For cap-exempt college employers, there's no lottery dependency, so the timing is more predictable. File early enough to avoid any gap between OPT expiration and the H-1B approval date.
