Verify your credentials meet ECFMG standards
International medical graduates must hold ECFMG certification before a U.S. employer can sponsor an H-1B. Confirm your medical degree is ECFMG-recognized early, as credential verification delays can push back your petition filing window by months.
Target academic medical centers with cap-exempt status
Hospitals affiliated with universities or nonprofit research institutions are often cap-exempt, meaning your H-1B petition bypasses the annual lottery. Surgical departments at these institutions can file at any time of year, giving you a faster and more predictable path to authorization.
Search verified H-1B sponsors on Migrate Mate
Use Migrate Mate to filter reconstructive surgeon roles by employers with confirmed LCA filing history for your SOC code. This surfaces institutions that have sponsored this specific role before, not just general surgical positions, narrowing your search to realistic opportunities.
Align your offer letter to the LCA wage level
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your occupation and work location. Check the OFLC Wage Search before accepting an offer to confirm the proposed salary meets the Level III or Level IV threshold typical for reconstructive surgery roles.
Clarify board certification requirements before the I-129 is filed
USCIS scrutinizes whether your qualifications match the specialty occupation definition. If you're board-eligible but not yet board-certified, your employer's attorney should document the equivalency argument in the petition, including your residency training records and fellowship credentials.
Track your 60-day grace period if your current status ends
If you're transitioning from a residency or fellowship J-1 visa or H-1B and your authorized period ends, USCIS allows a 60-day grace period to secure new sponsorship. Your prospective employer must file the new H-1B petition before that window closes to maintain your lawful status.
H-1B Visa Reconstructive Surgeon: Frequently Asked Questions
Does reconstructive surgery qualify as a specialty occupation for H-1B purposes?
Yes. Reconstructive surgery requires a medical degree, residency training, and typically fellowship-level subspecialty training, satisfying USCIS's specialty occupation definition under INA section 214(i). The role falls under a SOC code that DOL and USCIS consistently recognize as requiring a theoretical and practical application of highly specialized knowledge, making it a strong candidate for H-1B approval.
Which types of employers sponsor H-1B visas for reconstructive surgeons?
Academic medical centers, university-affiliated hospital systems, Veterans Affairs hospitals, and nonprofit surgical institutes are the most active sponsors. Many of these institutions qualify as cap-exempt H-1B employers, allowing them to file petitions outside the annual lottery. Private surgical groups and for-profit hospital networks also sponsor, but they are subject to the 85,000-slot annual cap and the registration lottery. Use Migrate Mate to find employers with verified LCA filing history for this specific role.
How does the H-1B prevailing wage requirement apply to reconstructive surgeon positions?
Your employer must file a Labor Condition Application with DOL certifying that your offered wage meets or exceeds the prevailing wage for your occupation and geographic area. Reconstructive surgery roles typically fall at wage Level III or Level IV under the OFLC Wage Search, reflecting the subspecialty training and clinical complexity involved. The LCA must be certified before USCIS will accept the I-129 petition.
Can I transfer my H-1B to a new reconstructive surgery position at a different hospital?
Yes, through H-1B portability under AC21. If your I-140 immigrant petition has been approved and your H-1B extension is pending for more than 180 days, you can change employers in a same or similar occupational classification without losing your priority date. Even outside that scenario, a new employer can file an H-1B transfer petition and you can begin work once USCIS receives it, without waiting for approval.
Does completing a U.S. fellowship on a J-1 affect my ability to get H-1B sponsorship?
It can, if your J-1 carries a two-year home residency requirement under INA section 212(e). You'd need to fulfill that requirement or obtain a waiver before USCIS can approve a change of status to H-1B. Waiver pathways available to physicians include a Conrad 30 state health agency waiver, a federal agency waiver, or a hardship or persecution waiver filed with USCIS.
