Verify your degree field matches the role
USCIS requires your degree to align specifically with recruitment or HR management, not just any business field. A degree in marketing or communications may trigger an RFE unless your coursework or transcript directly supports talent acquisition functions.
Check LCA filings for Recruitment Manager titles
Use the OFLC Wage Search to filter Labor Condition Applications by the SOC code 11-3121 (Human Resources Managers). This shows which employers have actively filed for this exact title and what prevailing wage levels they've certified.
Target cap-exempt employers to skip the lottery
Universities, nonprofit research institutions, and government-affiliated organizations are cap-exempt under USCIS rules. Recruitment Manager roles at these employers can be filed year-round, bypassing the annual H-1B lottery entirely.
Search Migrate Mate for verified sponsoring employers
Filter by Recruitment Manager roles on Migrate Mate to see employers with confirmed H-1B LCA filing history for this title. You'll see wage levels and filing patterns before applying, so you're not guessing which employers will sponsor.
Negotiate offer timing around the April filing window
H-1B cap-subject petitions must be filed in April for an October 1 start date. If you receive an offer in June, your employer can't file until the following April. Confirm your employer understands this timeline before accepting.
Document strategic HR contributions for specialty occupation evidence
USCIS scrutinizes Recruitment Manager petitions more than engineering roles. Your employer's support letter should detail how the role requires theoretical and practical HR knowledge, not just administrative tasks, to strengthen the specialty occupation argument.
H-1B Visa Recruitment Manager: Frequently Asked Questions
Does a Recruitment Manager role qualify as an H-1B specialty occupation?
Yes, Recruitment Manager qualifies when the employer can demonstrate the role requires at least a bachelor's degree in a specific field like human resources, organizational psychology, or business administration. USCIS applies more scrutiny to HR titles than technical roles, so the job description must reflect strategic workforce planning responsibilities rather than generalist administrative tasks.
Which industries most commonly sponsor H-1B visas for Recruitment Managers?
Technology companies, large professional services firms, healthcare systems, and staffing agencies file the most LCAs for HR Manager titles. Universities and nonprofit hospitals are especially useful targets because they're cap-exempt, meaning they can file year-round without entering the H-1B lottery. Use Migrate Mate to filter Recruitment Manager openings by employers with active LCA filing history.
What SOC code applies to Recruitment Manager roles for the LCA?
The Department of Labor assigns SOC code 11-3121 (Human Resources Managers) to most Recruitment Manager roles. Your employer uses this code when filing the Labor Condition Application with DOL. The SOC code also determines which prevailing wage level applies, which you can verify using the OFLC Wage Search before your offer is finalized.
Can a Recruitment Manager be sponsored for H-1B while working in a staffing or RPO firm?
Yes, but USCIS scrutinizes staffing firm H-1B petitions closely because the petitioner (the staffing firm) must demonstrate that the position is a legitimate specialty occupation requiring a specific degree. The staffing firm must show an employment relationship and that the Recruitment Manager role involves specialized knowledge, not just vendor coordination or high-volume sourcing work.
What happens to my H-1B status if my employer does a round of layoffs?
You have a 60-day grace period from the date your employment ends to find a new employer willing to file an H-1B transfer petition. During that window you're not authorized to work, but the clock gives you time to secure a new offer. Your new employer can file a transfer petition immediately and you may begin work once it's received by USCIS, without waiting for approval.
