Verify your degree meets specialty occupation
USCIS requires your degree field to directly relate to technical writing. A degree in English, communications, or information design is straightforward. A business or engineering degree needs a clear connection to documentation work, gather transcripts and be ready to articulate that link.
Target employers with active LCA filings
Use Migrate Mate to filter Senior Technical Writer roles by employers who have filed Labor Condition Applications for this specific title. LCA history confirms the employer has already navigated DOL requirements for the role, not just a willingness to sponsor in theory.
Check prevailing wage before salary negotiations
Your H-1B petition requires the employer to pay at least the DOL prevailing wage for your work location and job level. Run the OFLC Wage Search using SOC code 27-3042 before any offer discussion so you know the minimum the employer must legally commit to.
Build a portfolio that maps to O*NET tasks
USCIS scrutinizes specialty occupation status for technical writers more than for engineering roles. Structure your portfolio around O*NET task descriptions for Technical Writers, emphasizing API documentation, structured authoring, or regulated-industry deliverables strengthens the specialty occupation argument in your petition.
Clarify who covers H-1B filing fees upfront
Employers are legally prohibited from shifting certain mandatory H-1B filing fees onto you. Confirm in writing before signing that the employer covers the I-129 filing fee and any premium processing they require. Attorney fees are negotiable but the statutory fees are not your responsibility.
File for premium processing if your start date is fixed
Standard H-1B adjudication runs several months after October 1 approval. If your role has a specific project launch or contract start date, ask your employer to file Form I-907 with USCIS for premium processing, which guarantees a decision within 15 business days.
H-1B Visa Senior Technical Writer: Frequently Asked Questions
Does a Senior Technical Writer role qualify as an H-1B specialty occupation?
Yes, but the employer needs to demonstrate the position normally requires a bachelor's degree in a specific field, not just any degree. Roles involving API documentation, regulated-industry content, or DITA-based structured authoring carry a stronger specialty occupation argument than general content editing. USCIS has issued RFEs for technical writer petitions where the job description was too broad, so a precise job description matters.
Which industries sponsor H-1B visas for Senior Technical Writers most often?
Software development, aerospace and defense, medical device manufacturing, and federal contractors file LCAs for Senior Technical Writer roles most frequently because documentation is a compliance or contractual requirement in those sectors, not optional. You can browse verified H-1B-sponsoring employers for this role on Migrate Mate, filtered by LCA filing history for the exact job title.
Can my employer apply for H-1B sponsorship if I'm already working on OPT?
Yes. Your employer files the H-1B petition during the April registration window, and if selected, the petition is approved with an October 1 start date. If you're on OPT that expires before October 1, the cap-gap rule extends your work authorization automatically while the approved petition is pending, provided you filed before your OPT end date.
What happens to my H-1B if I switch employers as a Senior Technical Writer?
H-1B portability under AC21 lets you transfer your status to a new employer once your petition has been pending for 180 days or is already approved. The new employer files an H-1B transfer petition, and you can start working for them as soon as the receipt notice is issued, you don't need to wait for final approval before your start date.
Is it common for Senior Technical Writer roles to be posted with H-1B sponsorship available?
Many job postings omit sponsorship details entirely, even when the employer sponsors routinely. The most reliable signal is the employer's actual LCA filing history for technical writer titles, not the job posting language. Checking an employer's DOL filing record before applying saves time spent on companies that state 'no sponsorship' only after the interview process.
