Align your credentials to specialty occupation standards
USCIS requires your role to qualify as a specialty occupation. A bachelor's degree in human resources, organizational psychology, or business is the baseline. Document any advanced credentials, SHRM certifications, or specialized HR technology expertise to strengthen the petition.
Target employers with HR LCA filing history
Search Migrate Mate to find companies that have already filed LCAs for talent acquisition and HR leadership roles. Prior filing history in your occupation code signals that the employer understands the H-1B process and has legal infrastructure in place.
Verify the prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for a Talent Acquisition Director in the specific metro area. Run the OFLC Wage Search using SOC code 11-3121 before salary discussions so you know the floor and can negotiate above it.
Ask about cap-exempt employer eligibility early
Nonprofit organizations, universities, and government research entities are cap-exempt, meaning your H-1B can be filed outside the annual lottery. Talent acquisition roles at these institutions are genuinely common, so confirm an employer's cap-exempt status before the offer stage.
Prepare a specialty occupation evidence file now
Talent acquisition roles face RFEs when USCIS questions whether the job requires a specific degree field. Gather your degree transcripts, job description drafts, and any O*NET occupational profile documentation for HR managers so your employer's attorney can build a stronger I-129 petition.
Use your 60-day grace period strategically if laid off
H-1B holders have a 60-day grace period after involuntary termination to find a new sponsoring employer. Talent acquisition roles typically have longer hiring cycles, so start your search immediately and prioritize companies with established H-1B programs to meet that window.

Find Talent Acquisition Director JobsTalent Acquisition Director H-1B Visa: Frequently Asked Questions
Does a Talent Acquisition Director role qualify as an H-1B specialty occupation?
Yes, provided the position genuinely requires a bachelor's degree or higher in a specific field such as human resources, organizational behavior, or business administration. USCIS scrutinizes generalist management titles more than technical ones, so the job description must specify the required degree field rather than just listing HR experience as acceptable.
Which employers are most likely to sponsor H-1B visas for this role?
Large technology companies, professional services firms, financial institutions, and healthcare systems regularly file H-1B LCAs for HR leadership roles because they already run high-volume H-1B programs and have dedicated immigration counsel. You can filter for employers with active filing history in talent acquisition and HR leadership on Migrate Mate rather than applying blindly.
Can I transfer my H-1B to a new employer if I'm already in status?
Yes. An H-1B portability transfer lets you start working for a new employer as soon as the new I-129 petition is filed, without waiting for approval, as long as you're maintaining valid status and your prior petition was properly approved. The new employer files the transfer petition and covers the associated USCIS fees.
How does the H-1B lottery affect my job search timeline as a Talent Acquisition Director?
If you need a cap-subject H-1B, registration opens in March and selection happens before April 1, with employment starting no earlier than October 1. This creates a six-month gap between offer acceptance and your start date, so you'll need to negotiate a deferred start or have an employer willing to plan that far ahead.
Is my HR or people operations experience enough to meet the degree requirement, or do I need a specific major?
USCIS looks for a direct relationship between your degree field and the job duties. Years of HR experience alone don't substitute for the degree requirement on an H-1B petition. A degree in human resources management, industrial-organizational psychology, or business with an HR concentration is the strongest foundation, though related fields supported by coursework analysis can also qualify.
