Position Summary: The Sr Corporate Counsel - Risk & Safety is responsible for managing and providing legal advice regarding a wide range of claims, litigation, investigations, and other risk management, safety, and related insurance matters. The incumbent will provide legal services and play a critical role supporting the Company’s operations in the environmental services industry throughout the United States and Canada.
PRINCIPAL RESPONSIBILITIES:
- Provides legal and professional support to the organization related to risk management, safety, and related insurance matters.
- Partners with Risk Department and provides legal support related to incident investigation, insurance, loss/exposure, policies and procedures, training, and other matters.
- Manages claims and litigation relating to alleged bodily injury, property damage, negligence, and nuisance; and provides support related to indemnity and insurance coverage, including by working with third-party claims administrator and claims adjusters.
- Partners with the Safety Department and provides legal support related to safety initiatives, citations, investigations, policies and procedures, training, Occupational Safety and Health Administration (OSHA) and state agency inquiries, and other matters.
- Provides advice and counsel regarding the Company’s drug and alcohol testing program, including Department of Transportation (DOT) requirements.
- Mitigates risk and provides strategic recommendations and advice relating to regulatory changes and support of companywide compliance programs.
- Litigation support includes selecting and managing outside counsel and internal staff; communicating key case updates internally and supporting external communications; preparing legal budgets and recommended reserves; supporting the selection, preparation, disclosures, deposition, and defense of Company and expert witnesses; and participating in select depositions, mediations, hearings, and trials of significance.
- Advises on insurance coverage, joint defense, indemnity and hold harmless agreements.
- Provides training to management and corporate and field personnel.
- Drafts and contributes to reports to the organization’s Chief Legal Officer, senior management, auditors, and Audit Committee of the Board of Directors.
- Performs other job-related duties as assigned or apparent.
QUALIFICATIONS
- At least 10 years of experience performing the types of legal work identified above.
- Experience working in a large, multi-state corporate or legal environment; or as in-house counsel.
- Excellent judgment; high integrity; and strong collaboration skills.
- Knowledge of federal, state, and local statutes and regulations applicable to publicly-traded organizations.
- Outstanding written and oral communications skills as well as organizational and time management skills.
- A proven track record demonstrating the ability to independently make decisions regarding complex legal and corporate issues, including a strong ability to analyze case law and provide recommendations to business partners.
- Overnight travel required.
MINIMUM REQUIREMENTS:
- JD; licensed to practice law and in good standing.
- Minimum of seven years of experience as a practicing attorney.
This is an in-office position at our headquarters in Phoenix, Arizona. Attractive relocation package included with out-of-state offer.
