Get Access To All JobsTips for Finding TN Visa Sponsorship in Senior Litigation Counsel
Confirm your bar admission covers U.S. practice
TN visa sponsorship for Senior Litigation Counsel requires bar admission in at least one jurisdiction. A Canadian law degree alone isn't enough if you haven't cleared a U.S. bar or a reciprocal licensing pathway your employer can document.
Target law firms with active federal dockets
Senior Litigation Counsel roles at firms handling federal civil or criminal matters are more likely to work with visa sponsorship. Employers with recent visa filings demonstrate experience navigating sponsorship processes, helping narrow your search to firms familiar with supporting international legal talent.
Request a role-specific offer letter before filing
CBP requires the offer letter to explicitly describe litigation duties, not just the job title. Vague language like "legal work" invites secondary inspection. Specify trial preparation, motion practice, or appellate work to match the TN Lawyer category.
Use Migrate Mate to surface TN-ready employers
Migrate Mate filters Senior Litigation Counsel openings by TN visa sponsorship availability, so you're not cold-applying to firms that have never sponsored. Search by practice area to find active litigation departments with existing TN infrastructure.
Prepare credential documentation for Mexican nationals
Mexican nationals applying through a U.S. consulate must show a licenciatura in law, not just bar passage. Have your degree apostilled and translated before scheduling your appointment, since consular officers verify credentials at the interview.
Align your start date with TN processing timelines
Canadian citizens can get TN status at a port of entry the same day, but Mexican nationals face consular wait times that can run several weeks. Negotiate a start date with your employer that accounts for appointment availability, not just offer acceptance.
Senior Litigation Counsel TN Visa: Frequently Asked Questions
Does a Senior Litigation Counsel role qualify for TN visa status?
Yes, Senior Litigation Counsel positions qualify under the TN visa's Lawyer category, which covers Canadian and Mexican nationals holding a law degree and bar admission who will practice law in the U.S. The role must involve substantive legal work, meaning litigation duties like trial preparation, depositions, and motion practice must be documented in the offer letter. A title alone doesn't guarantee approval.
How does the TN visa compare to H-1B for Senior Litigation Counsel roles?
The TN visa has no annual lottery and no cap for Canadian nationals, making it far more predictable than the H-1B visa for attorney roles. H-1B petitions require USCIS adjudication that can take months, while a Canadian national can receive TN status at a port of entry the same day with the right documentation. Mexican nationals still go through consular processing, but avoid the H-1B lottery entirely.
What documentation does my employer need to prepare for TN sponsorship?
Your employer needs to provide a detailed offer letter confirming your law degree requirement, the litigation-specific nature of the role, and your start date and compensation terms. Unlike H-1B, there's no I-129 petition for Canadian applicants entering at a port of entry, but the offer letter does the work a petition would otherwise do. USCIS adjudication only applies if you're filing for a change of status from inside the U.S.
Where can I find Senior Litigation Counsel jobs that already offer TN visa sponsorship?
Migrate Mate is built specifically to connect Canadian and Mexican professionals with U.S. employers who sponsor TN visas. Searching by job title and visa type on Migrate Mate filters out roles where sponsorship isn't available, which saves significant time when targeting litigation-focused law firms and corporate legal departments that already have TN infrastructure in place.
Can I switch employers after receiving TN status as a Senior Litigation Counsel?
Yes, but your TN status is tied to a specific employer and role. If you change jobs, you'll need new TN documentation reflecting the new employer's offer letter and litigation role description. Canadian nationals can process this at a port of entry, while Mexican nationals must return to a U.S. consulate. You cannot begin work for a new employer on your existing TN authorization.
