Position Summary
The Senior Counsel position will report to the EVP and General Counsel, and will provide legal support for a growing national credit card bank.
Summary of Essential Job Functions
Consumer Financial Services Litigation
- Manage and oversee nationwide litigation portfolio, including TCPA, FCRA, consumer lending and other consumer finance matters.
- Develop litigation strategy, manage outside counsel and drive efficient resolution of matters.
- Monitor litigation trends, significant judicial decision and enforcement actions impacting consumer financial services and advise management accordingly.
- Stay current on state and federal legislative and regulatory developments affecting the bank's operations, products, customer communications, and compliance obligations.
- As time permits, for candidates with demonstrated trial/arbitration skills, opportunity to independently handle arbitrations or selected local litigation matters.
- Support employment litigation or employment-related inquiries, as needed.
Candidates interested in expanding their experience may contribute to one or more of the following areas:
- Marketing, Product Development and Disclosure Support
- Collaborating with marketing, risk and compliance to develop and approve marketing materials and disclosures for credit cards, deposits and loyalty programs.
Commercial Contracting
- Review, draft and negotiate a wide range of agreements, including marketing and sponsorship agreements; supply chain, ecommerce and servicing contracts, SaaS and technology vendor agreements; payment systems agreements; and NDAs and professional services agreements.
Regulatory Monitoring & Research
- Tracks summarize and communicate legal developments, including new legislation, proposed rules, regulatory guidance and enforcement across agencies such as the CFPB, OCC and others.
Position Requirements
- Juris Doctorate degree and a state bar license; must be qualified to register as in-house counsel in Nevada or be licensed as an attorney in Nevada.
- At least 7+ years prior experience (preferably with a bank or law firm with an emphasis on consumer credit or consumer credit litigation, although relevant financial services experience will be considered).
- Experience managing non-attorney staff. This position may oversee non-lawyer personnel who provide litigation support services.
- Must be tech savvy and not intimidated by new systems.
- Experience or familiarity with bank regulatory matters would be helpful.
- Demonstrated ability to provide counsel and guidance on matters ranging from complex legal questions or inquiries to routine day-to-day legal matters.
- Familiarity with Reg B, Reg Z, FCRA, TCPA, BSA, E-Sign, CAN-SPAM, Dodd Frank, GLB, CCPA and privacy, and UDAAP.
- Familiarity with employment law a plus.
- Outstanding business judgement.
