Confirm your bar admission transfers cleanly
TN visa classification for lawyers requires bar admission in at least one jurisdiction. If you're licensed in a Canadian province or Mexican state, verify that your credential letter explicitly states active good standing, not just graduation from law school.
Target companies with existing legal departments
In-house General Counsel roles at companies with established legal teams are far easier to convert to TN sponsorship. Their HR and finance teams already understand the compliance requirements, which shortens your negotiation over filing timelines significantly.
Secure a detailed offer letter before the border
Canadian citizens present TN documentation directly at a port of entry. Your offer letter must specify the legal duties, confirm you'll function as principal legal officer, and name the USMCA lawyer category. Vague titles like 'legal advisor' can trigger additional questioning.
Use Migrate Mate to find employers already sponsoring TN roles
Search Migrate Mate to identify companies actively hiring General Counsel candidates under TN visa sponsorship. It filters roles by visa type so you're not spending time on positions where the employer hasn't yet committed to sponsoring international legal professionals.
Prepare for Mexican nationals' consular appointment timeline
Mexican citizens must obtain TN status through a U.S. consulate, unlike Canadians who qualify at the border. Factor in consular appointment availability when negotiating your start date with the employer, since backlogs can run several weeks.
Clarify the company's legal structure before accepting
General Counsel roles at subsidiaries of foreign parent companies sometimes complicate TN filings when the employing entity shifts mid-process. Confirm in writing which U.S. legal entity is your employer of record before your offer letter is finalized.
General Counsel TN Visa: Frequently Asked Questions
Does the General Counsel role qualify for TN visa status?
Yes, General Counsel positions qualify under the USMCA's lawyer occupational category, which covers legal roles requiring a law degree and active bar admission. The key is that your duties must be primarily legal in nature. Purely executive or administrative responsibilities without a legal function can put the classification at risk.
How does TN visa sponsorship for General Counsel compare to H-1B?
TN has no annual lottery, no cap for Canadian citizens, and no multi-month USCIS adjudication wait. Canadian applicants can receive TN status at the border the same day. H-1B visa requires USCIS petitioning, often takes six months or more, and is subject to an annual lottery with roughly a one-in-four selection rate. For qualified Canadian and Mexican lawyers, TN is a faster and more predictable path.
Where can I find General Counsel jobs that offer TN visa sponsorship?
Migrate Mate is built specifically for this search. It surfaces in-house General Counsel roles at companies that have indicated openness to TN visa sponsorship, so you can skip screening calls with employers unfamiliar with the USMCA lawyer category. Standard job boards don't filter by visa type, which wastes time for Canadian and Mexican professionals.
Can a General Counsel on TN status become a permanent employee?
TN status does not allow immigrant intent, meaning you cannot simultaneously pursue a green card while holding TN status. Some General Counsel candidates transition to an EB-1 or EB-2 National Interest Waiver path through a separate process, but this requires careful timing with immigration counsel to avoid jeopardizing the nonimmigrant classification.
What documents does a General Counsel applicant need for TN sponsorship?
You'll need a detailed employer offer letter specifying your legal duties and the USMCA lawyer category, proof of bar admission in good standing from a recognized jurisdiction, and your law degree. Canadian citizens present these at a U.S. port of entry. Mexican citizens file through a U.S. consulate and will also need a DS-160 and appointment confirmation.
