The Attorney General is the chief legal officer of the State of Maryland. The Office of the Attorney General (OAG) has the general charge, supervision, and direction of the State’s legal business, acting as legal advisors and representatives of the major agencies, various boards, commissions, officials, and institutions of State Government. The OAG also protects the public by civil enforcement of antitrust, civil rights, consumer protection, and securities laws and regulations and by the prosecution of organized crime, Medicaid fraud, environmental crimes, insurance fraud, state tax evasion, and other statutorily assigned matters. As Maryland’s 47th Attorney General, Anthony G. Brown leads the Office with a critical focus on equity, justice, and fairness.

The OAG is seeking a skilled and motivated attorney to serve as an Assistant Attorney General (AAG) for the Maryland Higher Education Commission (MHEC). MHEC is the State’s higher education regulatory and coordinating board, responsible for establishing statewide policies for Maryland’s public and private colleges and universities, as well as for for-profit career schools. MHEC also administers more than $100 million annually through financial aid programs that help students achieve their higher education goals.

The Assistant Attorney General will represent MHEC in administrative litigation before the Maryland Office of Administrative Hearings and will provide legal advice on a wide range of matters including statutory interpretation, regulatory interpretation, administrative appeals of agency decisions, conducting Commission proceedings in accordance with Commission bylaws and the Open Meetings Act. Additional responsibilities include reviewing contracts and grant agreements and providing legal advice related to drafting regulations pertaining to higher education program approval, administration of financial aid programs, and other matters; and ensuring agency compliance with Public Information Act requests as well as employment-related law. The position reports to the Principal Counsel, as part of a team of two attorneys providing legal advice and representation to MHEC.

The AAG will draft legal advisory memoranda, provide legal counsel to the Commissioner, the Secretary, and MHEC staff, and advise on the legal framework governing agency decision-making. The AAG will regularly interact with senior agency officials in the course of providing legal advice and representation.

Classification: Assistant Attorney General III

Experience: The ideal candidate will have a minimum of five years of progressively responsible civil litigation experience; Maryland Bar membership or eligibility to waive in; Strong analytical, writing, and oral advocacy skills are essential. Candidates must demonstrate the ability to manage multiple high stakes matters, provide clear and practical client guidance, and develop litigation strategies that lead to favorable outcomes.

Preferred Qualifications: Experience in administrative law, administrative litigation, employment and personnel matters, and government procurement matters.
