How to Get Visa Sponsorship in AI Solution Architect
Target consulting firms and system integrators first
Accenture, Deloitte, Cognizant, and similar firms sponsor H-1B workers at scale and have established immigration teams. They hire AI Solution Architects regularly and are experienced with the full petition process, reducing delays.
Frame your degree around AI and systems architecture
USCIS evaluates whether your degree directly relates to the role. A computer science, software engineering, or information systems degree maps cleanly. If your degree is adjacent, prepare a credential evaluation letter addressing the specialty occupation connection.
Document cloud certifications alongside your credentials
AWS, Azure, and Google Cloud certifications signal role-specific expertise to employers. Sponsoring companies want confidence you can deliver before investing in a petition. Certifications strengthen your case during hiring and support the specialty occupation argument.
Understand the LCA requirement before your offer letter
Your employer must file a Labor Condition Application with the Department of Labor before submitting your H-1B petition. Confirm your prospective employer has done this before or has an immigration attorney on retainer to manage it.
Apply during H-1B cap season if you're outside the U.S.
H-1B registrations open each March for an October start date. If you're offshore and need cap-subject status, time your job search to have an offer confirmed by late February so your employer can register you in the lottery window.
Highlight enterprise architecture experience in your resume
Employers justify sponsorship cost when they can't easily hire domestically. Demonstrating specialized skills in AI integration, cloud-native design, or large-scale solution delivery makes the business case for your petition stronger and faster to approve.

Is AI Solution Architect considered a specialty occupation for H-1B purposes?
Yes. AI Solution Architect consistently qualifies as a specialty occupation under USCIS criteria because the role theoretically and practically requires at least a bachelor's degree in computer science, information technology, or a closely related field. USCIS has approved thousands of H-1B petitions for solution architect titles across cloud, enterprise, and AI-focused contexts. Roles with generic titles like 'Solutions Consultant' can face more scrutiny, so job title specificity matters.
Which visa types are most commonly used to sponsor AI Solution Architects?
H-1B is by far the most common, used for full-time positions requiring specialty occupation status. O-1A is an option for architects with demonstrated extraordinary ability, such as published research, speaking engagements, or named contributions to widely adopted AI systems. Australians may qualify for the E-3, which has no lottery and faster processing. Canadian and Mexican citizens can explore the TN visa under the USMCA for certain engineering and computer-related roles.
Does my degree field need to exactly match 'AI' to qualify for this role?
Not exactly. USCIS accepts degrees in computer science, software engineering, mathematics, electrical engineering, or information systems as qualifying for AI Solution Architect roles. A degree in an adjacent field can still qualify if you can demonstrate it provides the theoretical foundation for the work. If your degree is in a less technical area, employers can supplement with a credential evaluation or evidence of equivalent progressive work experience.
How do I find AI Solution Architect roles where employers are actively willing to sponsor?
Migrate Mate filters job listings specifically for roles where employers have an established sponsorship history. This saves significant time compared to applying broadly and discovering sponsorship policies only after an interview. Employers who have previously filed H-1B petitions for solution architect or similar titles are the most reliable targets, and Migrate Mate surfaces those opportunities directly.
Can an AI Solution Architect on H-1B change employers mid-status?
Yes, through H-1B portability. If you've been in valid H-1B status for at least 180 days after your initial approval and your new employer files a petition before your current status expires, you can begin working for the new employer once the receipt notice is issued. The new petition doesn't need to be approved first. This is particularly relevant in AI consulting, where project-based contracts sometimes lead to employer transitions.
What is the prevailing wage requirement for sponsored AI Solution Architect jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
