How to Get Visa Sponsorship as a Sous Chef
Target establishments with culinary education requirements
High-end restaurants and hotels that require culinary degrees or specialized training are more likely to sponsor visas, as they can demonstrate the role meets specialty occupation standards for H-1B approval.
Highlight specialized cuisine expertise
Emphasize expertise in specific cuisines, advanced techniques, or unique culinary traditions. USCIS views specialized knowledge as stronger justification for sponsorship than general cooking skills or basic food preparation experience.
Document formal culinary education
Culinary school diplomas, apprenticeships, or hospitality management degrees strengthen visa applications. Three years of progressive culinary experience can substitute for each year of missing formal education under degree equivalency rules.
Consider O-1 for exceptional culinary talent
Award-winning chefs or those with national recognition may qualify for O-1 visas. This path offers more flexibility than H-1B but requires extensive documentation of extraordinary ability and industry achievements.
Research hotel chains with sponsorship history
Major hotel groups like Marriott, Hilton, and Hyatt have established sponsorship programs. Check DOL disclosure data to identify which properties have successfully sponsored culinary positions in recent years.
Prepare for prevailing wage requirements
Employers must pay prevailing wages for the geographic area and experience level. Research regional wage standards through DOL databases to understand what sponsors must offer for compliant visa petitions.

Get Access To All JobsFrequently Asked Questions
Do sous chefs need a culinary degree for visa sponsorship?
Not always required, but it significantly helps H-1B approval. USCIS considers culinary arts degrees as qualifying for specialty occupation status. Without a degree, you'll need to demonstrate equivalent experience through progressive roles and specialized training. Three years of professional cooking experience can substitute for one year of education.
What visa types work best for sous chef positions?
H-1B is most common for degree-holding chefs at upscale establishments. O-1 works for award-winning or nationally recognized chefs with extraordinary ability. L-1 applies if transferring within the same restaurant group internationally. TN visa covers Canadian and Mexican chefs, though the specialty occupation requirement still applies.
How do restaurants prove a sous chef role needs sponsorship?
Employers must demonstrate the position requires specialized knowledge beyond basic cooking. This includes menu development, advanced techniques, specific cuisine expertise, or supervisory responsibilities. The job description should emphasize culinary degree requirements and specialized skills rather than routine food preparation tasks.
What's the approval rate for sous chef H-1B petitions?
USCIS doesn't publish role-specific data, but culinary positions face higher scrutiny than traditional specialty occupations. Success depends on the employer's ability to demonstrate degree requirements and specialized knowledge. High-end restaurants with formal culinary education requirements typically see better approval rates than casual dining establishments.
Can sous chefs switch employers while on a work visa?
Yes, but the new employer must file a new petition. H-1B portability allows you to start working once the new petition is filed, before approval. The new role must be in the same or similar occupational classification. O-1 transfers require the new petition to be approved before starting work.
What is the prevailing wage requirement for sponsored Sous Chef jobs?
U.S. employers sponsoring a visa must pay at least the prevailing wage, which is what workers in the same role, area, and experience level typically earn. The Department of Labor sets this rate to make sure companies aren't hiring foreign workers simply because they'd accept lower pay than a U.S. worker. It varies by job title, location, and experience. You can look up current prevailing wage rates for any occupation and location using the OFLC Wage Search page.
