Verify your NCLEX eligibility before applying
U.S. outpatient employers require a valid state RN license, which means passing the NCLEX-RN first. Apply to your target state's board of nursing early, credential verification through CGFNS can take eight to twelve weeks.
Confirm the role is classified as specialty occupation
Outpatient RN positions that list a BSN as required, not preferred, satisfy USCIS specialty occupation standards. If a job posting says 'bachelor's preferred,' ask the recruiter to confirm the formal job requirements before investing time in the application.
Negotiate LCA filing into your offer timeline
Your employer must file and receive a certified LCA from DOL before your visa interview. DOL certifies most LCAs within seven business days, so building two weeks of buffer into your start date prevents delays at the consulate.
Use Migrate Mate's E-3 filing service for your paperwork
Once you have a signed offer, use Migrate Mate's E-3 filing service to handle your LCA and visa paperwork end-to-end. This is especially useful for first-time E-3 applicants who aren't familiar with how consulate preparation works for nursing roles.
Address dual-intent at your visa interview proactively
Outpatient nursing roles attract strong immigrant visa demand, so consular officers sometimes probe nonimmigrant intent. Bring documentation of your Australian ties alongside your offer letter, LCA, and nursing license to demonstrate you intend to return if your status ends.
E-3 Visa Outpatient Registered Nurse: Frequently Asked Questions
How do I find outpatient RN jobs that offer E-3 visa sponsorship?
Migrate Mate is built specifically for this search. It surfaces outpatient RN roles from employers with active E-3 and H-1B sponsorship history, so you're not cold-applying to employers who have never filed an LCA. Filtering by role and visa type gets you to relevant postings far faster than a general job search.
How much does it cost to get an E-3 visa?
Migrate Mate's E-3 filing service covers the entire process for $499, including the Labor Condition Application, visa document preparation, and consulate appointment guidance. Traditional immigration lawyers charge $2,000–$5,000+ for the same work. The E-3 has less paperwork than most work visas, so paying thousands for legal help is usually unnecessary.
Does an outpatient RN role qualify as a specialty occupation for the E-3?
Yes, provided the employer requires a Bachelor of Science in Nursing as a formal job requirement. USCIS recognizes registered nursing as a specialty occupation when a BSN is mandatory, not just preferred. Roles listing 'ADN acceptable' can create complications, so confirm the degree requirement in writing before your employer files the LCA.
How does the E-3 compare to the H-1B for Australian outpatient nurses?
The E-3 has no annual cap and no lottery, so you can apply at any time of year and receive a decision at your consulate interview. H-1B registrations are capped at 85,000 per fiscal year with a randomized lottery, meaning many qualified nurses are rejected before their petition is ever reviewed. For Australians, the E-3 is a more reliable path.
Can I switch outpatient employers after arriving in the U.S. on an E-3?
You can change employers on an E-3, but your new employer must file a certified LCA and you'll need to obtain a new E-3 visa stamp before or at the time of the transition. You can't simply transfer your existing E-3 to a new job the way an H-1B holder can use portability rules. Plan for a two to four week processing window when changing roles.
