Match your degree to the role's PERM requirements
PERM certification locks in the minimum education requirement the employer advertises. If the job posting says 'bachelor's preferred' rather than 'required,' it weakens the EB-3 professional category case, so confirm the employer will specify a degree as a hard requirement before you invest time in the process.
Benchmark your salary against OFLC prevailing wages
DOL requires employers to pay at least the prevailing wage for your location and role level before PERM is certified. Use the OFLC Wage Search to look up your metro area before negotiating an offer, so you know the minimum the employer must meet by law.
Target employers already enrolled in E-Verify
PERM-sponsoring employers must be active, legitimate businesses, and E-Verify enrollment is a strong signal of compliance readiness. Companies already running I-9 verification through E-Verify tend to have HR infrastructure familiar with employment-based sponsorship filings, reducing the risk of delays caused by inexperienced compliance teams.
Search for green card sponsoring roles on Migrate Mate
Migrate Mate surfaces Business Development Assistant openings from employers with documented green card filing history, so you're not cold-applying and hoping. Filter by role and location to find companies already set up to run PERM for this job category without needing you to educate their HR team.
Clarify the sponsorship timeline before accepting an offer
PERM labor certification, I-140 approval, and adjustment of status can take two to four years in uncongested priority date queues. Ask the employer directly whether they will commit to sponsorship in the offer letter, and verify whether they use outside immigration counsel experienced with business development roles specifically.
Use your O*NET profile to strengthen the specialty occupation argument
Business development work can span administrative and analytical functions, so pull the O*NET occupation profile for your specific title and highlight the analytical, strategic, and cross-functional duties that support an advanced-degree requirement, strengthening the employer's EB-2 or EB-3 professional classification in the PERM application.

Find Business Development Assistant JobsBusiness Development Assistant Green Card Sponsorship: Frequently Asked Questions
Does a Business Development Assistant role qualify for EB-2 or EB-3 sponsorship?
It depends on how the employer defines the position. If the role requires a bachelor's degree in business, marketing, or a related field, it typically qualifies under EB-3 as a skilled professional. If the employer can justify an advanced degree requirement based on the complexity of duties, such as strategic analysis or cross-border partnership work, EB-2 becomes viable. The PERM job description is where that distinction gets locked in.
How does PERM green card sponsorship differ from H-1B for this role?
H-1B is a temporary work visa subject to an annual lottery, so there's no guarantee of selection even if you qualify. PERM-based green card sponsorship isn't capped by lottery at the EB-3 level for most nationalities, and it leads to permanent residency rather than a renewable temporary status. The tradeoff is time: the PERM process typically runs two to four years from start to green card approval, compared to H-1B's faster initial authorization.
Which employers actually sponsor green cards for Business Development Assistants?
Sponsorship is most common at mid-size and large companies in technology, financial services, consulting, and healthcare sectors, where business development functions are ongoing rather than project-based. Employers with existing immigration infrastructure and dedicated HR compliance teams are the most realistic candidates. Use Migrate Mate to filter job listings by employers with a documented history of employment-based green card filings for comparable roles.
What happens to my green card case if I change employers during the process?
If you're still in the PERM or I-140 stage, changing employers restarts the process entirely with the new company. Once your I-140 has been approved for more than 180 days and you're in the adjustment of status phase, federal portability rules under AC21 allow you to transfer the priority date to a new employer in the same or a similar occupational category, preserving your place in the queue.
Can I negotiate my offer knowing DOL sets a prevailing wage floor?
Yes, and you should. The DOL prevailing wage determined during PERM is a floor, not a ceiling. Employers are legally required to pay at least that amount, but you can negotiate above it. Reviewing the OFLC Wage Search for your metro area and role level before negotiations gives you a clear picture of where the minimum sits, so you're not leaving money on the table by treating the prevailing wage as the standard market rate.
