Document your degree field precisely
PERM requires your degree to align with the specific job duties, not just the title. A Development Manager role in software engineering needs a degree in computer science or a related technical field, not a general business degree, to survive DOL scrutiny.
Target employers with active PERM filings
Search the OFLC Wage Search to identify employers who have filed PERM applications for Development Manager or similar roles. Prior filings signal an established sponsorship process, reducing the risk that a new employer is learning as they go.
Distinguish EB-2 from EB-3 at the offer stage
If the job description genuinely requires a master's degree or equivalent, ask your employer to classify the role under EB-2 rather than EB-3. This matters most for applicants from India or China, where EB-2 priority dates move faster in some years.
Use Migrate Mate to filter green card sponsoring employers
Filter your Development Manager job search by employers with verified green card sponsorship history. Migrate Mate surfaces this data by role and industry so you can focus applications on companies already equipped to run the PERM process.
Check the O*NET profile before your PERM begins
Your employer's attorney will use the O*NET occupation profile for Development Manager to anchor the job requirements. Review it yourself so you can flag gaps between the official definition and your actual duties before the labor certification application is drafted.
Clarify concurrent filing eligibility with your employer
Once your I-140 is approved, ask whether your priority date allows concurrent filing of I-485. If it does, you can pursue adjustment of status and work authorization simultaneously rather than waiting through two separate USCIS queues.
Green Card Development Manager: Frequently Asked Questions
Does a Development Manager role qualify for EB-2 or EB-3 sponsorship?
Most Development Manager positions qualify for EB-3 sponsorship when they require a bachelor's degree in a relevant field such as engineering, computer science, or construction management. If the employer can document that the role genuinely requires a master's degree or equivalent professional experience, EB-2 classification may apply. Your employer's attorney determines the category based on the actual minimum requirements for the position, not your personal credentials.
How does green card sponsorship differ from H-1B for a Development Manager role?
Green card sponsorship through PERM and I-140 targets permanent residency rather than a temporary work period, and EB-3 has no annual lottery. The tradeoff is timeline: PERM labor certification alone can take six to twelve months before USCIS even receives the I-140 petition. H-1B visa processing can be faster, but it caps out at six years without an approved I-140, and lottery selection is not guaranteed. Many Development Managers pursue both simultaneously.
What does the PERM labor certification process require from my employer?
Your employer must run a supervised recruitment process through DOL to demonstrate no qualified U.S. workers applied for the Development Manager role. This includes placing specific advertisements, documenting all applicants reviewed, and filing the ETA 9089 form with PERM. The employer, not you, drives this process. Your role is to provide accurate employment history and educational credentials so the attorney can draft a job description that accurately reflects your background.
How can I find Development Manager jobs with green card sponsorship already in place?
Use Migrate Mate to search for Development Manager roles filtered by employers with verified green card sponsorship history. Rather than applying broadly and asking about sponsorship during interviews, this approach lets you target companies that have already completed PERM filings for comparable roles, which signals both willingness and operational readiness to sponsor a foreign national through the full EB process.
Can I change employers after my I-140 is approved but before I get my green card?
Yes, if your I-140 has been approved for at least 180 days and you move to a same or similar role, AC21 portability lets you keep your priority date and continue the green card process with a new employer. Development Manager positions within the same industry generally qualify as sufficiently similar. USCIS reviews portability claims at the I-485 adjudication stage, so your new employer should be prepared to document the job similarity.
