Align your degree to the role
PERM requires your degree field to match the job's requirements. A business administration or information systems degree supports most Functional Consultant filings, while an unrelated major can trigger a PERM denial even if your work history is strong.
Target employers with PERM filing history
Search the OFLC Wage Search to confirm an employer has certified PERM applications for Functional Consultant or related analyst roles. Employers who have filed before understand the process and are less likely to abandon sponsorship mid-application.
Clarify the EB tier before accepting an offer
Ask whether the employer intends to file under EB-2 or EB-3 before signing anything. EB-2 requires a master's degree or equivalent, while EB-3 covers bachelor's-level roles. The tier determines your priority date and how long you'll wait for a visa number.
Use Migrate Mate to filter green card roles
Search Migrate Mate to find Functional Consultant positions where employers have active green card sponsorship history. Filtering by sponsorship intent at the start saves months of outreach to employers who've never filed a PERM application.
Verify the prevailing wage before your interview
DOL sets the prevailing wage for your job title and location, and your offered salary must meet or exceed it for PERM certification. Use the OFLC Wage Search to check the wage level for Functional Consultant roles in your target city before negotiating compensation.
Understand how O*NET classification affects your filing
PERM applications require a Standard Occupational Classification code that matches your actual duties. Review the O*NET profile for Functional Consultant and related titles so you can confirm your employer's job description aligns with the correct SOC code before filing begins.
Green Card Functional Consultant: Frequently Asked Questions
Do Functional Consultant roles qualify for EB-2 or EB-3 green card sponsorship?
Most Functional Consultant positions qualify under EB-3 when the role requires a bachelor's degree in a relevant field like business, information systems, or computer science. EB-2 applies if the employer requires a master's degree or if you can demonstrate equivalent advanced credentials. Your employer's job description and the PERM labor certification determine which category applies.
How is green card sponsorship different from H-1B for a Functional Consultant?
H-1B visa is a temporary work visa capped at 85,000 per year and subject to an annual lottery. EB-3 green card sponsorship through PERM has no annual cap on applications, though visa numbers for certain countries can create waiting periods. The green card process is permanent: once approved, you're a lawful permanent resident, not subject to renewal or employer-tied status restrictions.
How long does the PERM and green card process take for this role?
PERM labor certification currently averages well over a year at DOL's analyst review stage. After PERM certification, your employer files an I-140 petition with USCIS, which can take several additional months. If you're from a country without a visa backlog, the full process from PERM filing to green card approval typically runs two to four years.
Where can I find Functional Consultant jobs that offer green card sponsorship?
Migrate Mate filters job listings by employers with green card sponsorship history, so you're not wasting time applying to companies that have never filed a PERM application. Searching by role and sponsorship type upfront is more effective than asking about green cards after an offer is already on the table.
Can my employer start the PERM process while I'm on H-1B status?
Yes, and starting early is strategically sound. Filing PERM while you're on H-1B lets you establish a priority date before your authorized stay becomes a concern. Under AC21 portability rules, if your I-140 has been approved for 180 days, you can change employers in a similar role without losing your place in the green card queue.
