Get Access To All JobsTips for Finding Green Card Sponsorship as a Genai Software Engineer
Align your credentials to EB-2 requirements
PERM filings for GenAI roles routinely cite a master's degree or higher in computer science, AI, or a related field. Document your advanced degree and any published research or patents before applying, since USCIS scrutinizes the job requirements closely.
Search employers with active PERM filing history
Use the OFLC Wage Search to identify companies that have filed PERM certifications for software engineering roles. Employers who have completed the PERM process before are far more likely to sponsor again and already understand the compliance timeline.
Verify the job description matches your O*NET profile
DOL cross-references PERM job duties against O*NET occupation data for GenAI and software engineer roles. Before accepting an offer, confirm that the employer's written job duties align with the O*NET profile your role falls under, or a prevailing-wage audit can stall your case.
Negotiate who covers attorney and filing fees
PERM regulations allow employers to pay all government filing fees, but attorney costs vary. Raise this during offer negotiation, not after signing, since some employers cap reimbursement and the difference can be significant across PERM, I-140, and adjustment of status filings.
Find green-card-sponsoring GenAI roles on Migrate Mate
Filtering by sponsorship willingness saves weeks of manual research. Migrate Mate surfaces GenAI software engineer positions where employers have a verified history of employment-based green card sponsorship, so you apply to companies already set up to file.
Time your application around your current visa status
If you're on H-1B visa, your I-485 adjustment of status can't be filed until a green card priority date is current for your country. Starting the PERM process early, even years before your H-1B expires, locks in an earlier priority date and protects you from cap-gap gaps.
Green Card Genai Software Engineer: Frequently Asked Questions
Does a GenAI software engineer role qualify for EB-2 or EB-3 sponsorship?
Most GenAI software engineer positions qualify for EB-2 when the employer requires a master's degree or higher in computer science, artificial intelligence, or a closely related field. Roles where a bachelor's degree is sufficient typically fall under EB-3. The classification depends on what the employer documents in the PERM labor certification, not just your personal credentials.
How does green card sponsorship differ from H-1B for a GenAI software engineer?
H-1B is a temporary nonimmigrant status with a six-year base limit and an annual lottery. Green card sponsorship through PERM and I-140 leads to permanent residency with no renewal requirement. There's no annual cap for EB-2 or EB-3 petitions themselves, though per-country visa backlogs can delay final approval for applicants from high-demand countries like India or China.
What does the PERM labor certification process look like for a GenAI role?
Your employer files a PERM application with DOL certifying that no qualified U.S. worker was available for the role. This requires a defined recruitment period, prevailing wage compliance verified through OFLC Wage Search data, and a job description tied to a specific O*NET occupation code. DOL processing currently runs several months, and an approved PERM must be filed within 18 months before it expires.
How do I find employers who will actually sponsor a green card for GenAI roles?
Migrate Mate is built specifically for this search, filtering job listings by employers with a documented history of employment-based green card sponsorship. Many GenAI-focused companies advertise roles without clarifying their sponsorship position, so using a platform that surfaces PERM filing history saves time and helps you prioritize companies already set up to file.
Can I switch employers after my PERM is approved but before I have my green card?
Yes, under AC21 portability rules you can change employers once your I-485 adjustment of status application has been pending for 180 days or more, provided the new role is in the same or a similar occupational classification. For GenAI software engineers, a move to another AI or software development position generally qualifies, but you'll want to confirm with an immigration attorney before accepting a new offer.
