Verify your CGFNS credential evaluation early
USCIS and sponsoring employers require a credentials evaluation for foreign-trained nurses before PERM filing begins. Getting your CGFNS certificate or VisaScreen in hand before you apply prevents delays that can push your green card timeline back by months.
Confirm your state nursing license before applying
PERM-based sponsorship for home health nurses requires an active RN license in the state where you'll work. Compact Nurse Licensure Compact states let one license cover multiple states, which expands the pool of employers who can legally hire and sponsor you.
Target home health agencies enrolled in E-Verify
Employers sponsoring EB-3 workers must complete I-9 verification, and agencies already enrolled in E-Verify have streamlined that step. Prioritizing these employers signals readiness to sponsor and often means a faster internal approval process for green card petitions.
Search green card sponsoring employers using Migrate Mate
Use Migrate Mate to filter home health nurse roles by employers with active PERM and I-140 filing history. Targeting agencies that have sponsored before cuts your research time and surfaces roles where the employer already understands the DOL and USCIS filing process.
Understand how prevailing wage affects your offer
Your employer must pay at least the DOL prevailing wage for your role and location before PERM is filed. Check the OFLC Wage Search tool for your county and job zone to confirm any offer meets or exceeds the required wage level before signing.
Negotiate a start date that accommodates PERM processing
PERM labor certification typically takes six to twelve months before the I-140 petition even begins. Ask your prospective employer whether they'll initiate PERM before your start date or concurrently, so your work authorization status doesn't create a gap in employment.
Green Card Home Health Nurse: Frequently Asked Questions
Do home health nurse employers commonly sponsor green cards, or is it rare?
Home health and home care agencies are among the more active sponsors for EB-3 green cards in nursing because the domestic labor shortage is well-documented, which makes PERM recruitment requirements easier to satisfy. Larger regional and national home health networks have established legal processes and sponsor regularly. Smaller independent agencies occasionally sponsor but often lack in-house immigration counsel, so the timeline can be less predictable.
How is EB-3 green card sponsorship different from H-1B sponsorship for nurses?
Green card sponsorship through PERM and EB-3 leads to permanent residency rather than a temporary status with an expiration date. Unlike H-1B visa, there is no annual lottery for EB-3, and nurses from most countries outside India and China typically see shorter waits for a visa number to become available. The tradeoff is a longer overall process: PERM, I-140, then adjustment of status or consular processing, which can take one to three years in total.
Does the home health nurse role qualify for EB-2 or only EB-3?
Most home health RN positions are filed under EB-3, which covers skilled workers requiring at least two years of training or a bachelor's degree. EB-2 is available if the role specifically requires a master's degree or if you qualify for a National Interest Waiver, which requires demonstrating that your work benefits the U.S. broadly. Standard home health nursing jobs are almost always sponsored at the EB-3 level.
Where can I find home health nurse jobs that offer green card sponsorship?
Migrate Mate lets you search home health nurse roles specifically filtered by employers with PERM and I-140 filing history, so you're not wasting applications on agencies that have never sponsored before. This is more targeted than a general job search because you're filtering by actual green card activity, not just job descriptions that mention visa sponsorship loosely.
Can I change home health employers after my green card process has started?
If your I-140 has been approved and your priority date is more than 180 days old, portability rules allow you to change to a same or similar nursing role with a different employer without restarting the green card process. If you're still in the PERM stage, changing employers generally means starting over. Confirm the job duties of any new role closely match your original PERM job description before making a move.
