Align your credentials before applying
USCIS scrutinizes foreign nursing credentials closely. Get your transcripts evaluated by a CGFNS-accepted credential evaluation service and confirm your state NP license is in good standing before any employer begins PERM recruitment.
Target hospitals with established PERM history
Health systems that routinely sponsor foreign clinicians already have immigration counsel on retainer and understand DOL prevailing-wage requirements. Smaller private practices often lack the infrastructure to complete a multi-year PERM process.
Ask about EB-2 versus EB-3 before accepting an offer
If you hold a master's degree and the role requires one, your employer can file under EB-2, which can shorten your wait significantly for most countries. Confirm the job description supports that classification before the offer is finalized.
Verify the employer's prevailing wage obligation
Use the OFLC Wage Search to check the DOL prevailing wage for your specialty and practice setting. Your offer must meet or exceed this figure throughout the PERM and I-140 process, not just at hire.
Search for sponsoring employers using Migrate Mate
Filter NP roles by green card sponsorship history on Migrate Mate to identify employers who have successfully completed PERM filings for advanced practice clinicians, cutting out the guesswork of cold outreach.
Understand concurrent filing and its timing advantage
If your priority date is current when the I-140 is approved, you can file your I-485 adjustment of status concurrently rather than waiting in separate queues. Confirm with your employer's immigration counsel whether your country of birth makes concurrent filing realistic.
Green Card NP: Frequently Asked Questions
Do NP roles typically qualify for EB-2 or EB-3 green card sponsorship?
Most NP positions qualify for EB-3 as skilled workers requiring at least a bachelor's degree and licensure. If the role formally requires a master's degree in nursing or a related field, your employer may be able to file under EB-2 instead, which can mean a shorter wait time for professionals born in countries without significant backlogs. The job description on the PERM application must accurately reflect whichever classification your employer selects.
How does green card sponsorship differ from H-1B sponsorship for NPs?
The green card route through PERM leads to permanent residency rather than a temporary status that requires repeated renewal. There is no annual lottery and no cap concern at the EB-3 level for most countries, unlike the H-1B visa. The trade-off is time: PERM recruitment and DOL review can take 12 to 24 months before the I-140 is even filed, so starting early matters.
What does the PERM recruitment process look like for an NP employer?
Your employer must conduct DOL-mandated recruitment steps, including job postings and newspaper advertisements, to demonstrate no qualified U.S. worker is available. USCIS and DOL require this good-faith effort before the application is submitted. Any qualified U.S. applicant who applies during the recruitment window can reset the process, so employers with active HR teams run this more smoothly than those without dedicated support.
How can I find NP employers who will actually sponsor a green card?
Use Migrate Mate to filter NP job listings by employers with documented green card sponsorship history. This surfaces health systems and practice groups that have completed PERM filings for advanced practice clinicians before, rather than employers who might consider sponsorship in theory but have never done it.
Does my NP specialization affect green card eligibility or timeline?
Specialization affects both the PERM job description and the prevailing wage tier your employer must meet, but it does not change your eligibility category or priority date queue. Specialties with documented U.S. worker shortages, such as psychiatric or rural primary care, may face less PERM audit risk because employer recruitment efforts are easier to substantiate. Check the O*NET occupation profile for your specialty to understand how DOL classifies the role.
