Align your portfolio to PERM requirements
PERM requires your employer to document that no qualified U.S. worker is available for the exact role. Structure your portfolio around specialized skills like DFM, tolerance stack-up analysis, or CAD toolchains that distinguish your candidacy from generalist applicants.
Verify prevailing wage before accepting offers
Use the OFLC Wage Search to look up the prevailing wage for Product Design Engineer under your target location before negotiating. Your offered salary must meet or exceed this figure, or DOL will reject the LCA filing that precedes PERM.
Target employers with in-house immigration infrastructure
Hardware and consumer electronics companies with dedicated legal or HR immigration teams process PERM filings faster and with fewer errors. Ask recruiters directly whether the company has filed employment-based green card petitions before, not just H-1B visa sponsorship.
Search for green card sponsoring roles on Migrate Mate
Filter for Product Design Engineer positions where employers have active EB-2 or EB-3 filing history. Migrate Mate surfaces this sponsorship data so you can prioritize outreach to companies already running the PERM process for this job category.
Confirm your degree field matches the job description
PERM applications tie the minimum education requirement to the specific role. If your degree is in mechanical engineering but the job description lists industrial design, flag this with your employer's attorney early. A mismatch can trigger a PERM denial or RFE at the I-140 stage.
Understand EB-2 versus EB-3 category fit early
Roles requiring only a bachelor's degree typically fall under EB-3. If your employer lists a master's degree as a requirement and you hold one, filing under EB-2 may reduce your priority date wait. Discuss this with the sponsoring employer before PERM is filed, not after.
Green Card Product Design Engineer: Frequently Asked Questions
Do Product Design Engineer roles commonly qualify for EB-2 or EB-3 green card sponsorship?
Both categories apply depending on how the employer structures the job requirements. EB-3 covers roles where a bachelor's degree in engineering or a related field is the minimum requirement. EB-2 applies when the position genuinely requires an advanced degree and your employer can document that requirement in the PERM filing. Employers in hardware and consumer electronics frequently sponsor this title under both categories.
How does the PERM green card process differ from H-1B sponsorship for Product Design Engineers?
H-1B is a temporary nonimmigrant status capped at 85,000 annually with a lottery. PERM is the first stage of permanent residency and has no annual cap on filings. The process takes longer overall, but the outcome is lawful permanent residency rather than a time-limited status. For EB-3 applicants from most countries, priority date backlogs are shorter than EB-2, making EB-3 a practical path for many Product Design Engineers.
What does the PERM labor certification process look like for a Product Design Engineer?
Your employer files ETA Form 9089 with the DOL's OFLC after completing a mandatory recruitment campaign to demonstrate no qualified U.S. worker is available. PERM approval allows your employer to file an I-140 immigrant petition with USCIS. Once approved and your priority date is current, you can file for adjustment of status or apply for an immigrant visa at a U.S. consulate.
How can I find Product Design Engineer jobs where employers are actively sponsoring green cards?
Use Migrate Mate to search for Product Design Engineer roles filtered by employers with documented EB-2 or EB-3 sponsorship history. This lets you focus your applications on companies already running the PERM process for this job category rather than cold-pitching employers who have never sponsored employment-based green cards for engineering roles.
Can my employer start the PERM process while I'm on H-1B, and what happens to my status during the wait?
Yes, employers can file PERM while you hold H-1B status. Under AC21 portability rules, if your I-140 has been approved for 180 days or more and your priority date is current, you can change employers or roles within the same occupational classification without losing your green card application progress. H-1B extensions beyond the standard six-year cap are also available once PERM or I-140 has been pending or approved for 365 days.
