Verify your degree aligns with PERM requirements
PERM requires the employer to document that a bachelor's degree in construction management, civil engineering, or a directly related field is genuinely required for the role. A general construction background without a matching degree can stall your EB-3 filing.
Target general contractors with multi-state portfolios
Large general contractors managing federal, commercial, or infrastructure projects across multiple states are far more likely to have in-house immigration counsel and an established PERM filing process than regional residential builders.
Search sponsoring employers by role using Migrate Mate
Filter Project Superintendent listings by green card sponsorship history on Migrate Mate to surface employers who have previously filed PERM or I-140 petitions for this specific job title, not just general construction roles.
Confirm prevailing wage before accepting an offer
Use the OFLC Wage Search to look up the prevailing wage for Project Superintendent in your target metro area. Your offered salary must meet or exceed this figure, or DOL will reject the PERM labor certification.
Clarify sponsorship intent during the offer stage
Ask directly whether the employer's offer letter will reference green card sponsorship and who covers PERM filing costs. Employers cannot legally deduct PERM attorney fees from your wages under DOL rules.
Gather field credentials that strengthen your I-140 petition
OSHA certifications, LEED accreditation, union foreman history, and project close-out documentation all support your EB-2 or EB-3 petition by establishing that you meet the specialty occupation standard the employer listed in the PERM application.
Green Card Project Superintendent: Frequently Asked Questions
Does a Project Superintendent role qualify for EB-2 or EB-3 green card sponsorship?
Most Project Superintendent positions qualify under EB-3 as skilled workers when the employer can document a minimum requirement of a bachelor's degree and relevant field experience. EB-2 sponsorship is available if the role requires an advanced degree in construction management or engineering, or if you have a combination of education and progressively responsible experience that satisfies the EB-2 advanced-degree professionals standard.
How does green card sponsorship differ from H-1B sponsorship for this role?
Green card sponsorship through PERM and I-140 is permanent rather than temporary, and EB-3 petitions are not subject to the H-1B visa annual lottery. The tradeoff is timeline: PERM labor certification alone can take six to twelve months before your I-140 is even filed. H-1B approval can place you in a role within months, while the green card process runs concurrently in the background and leads to lawful permanent residency.
What does the PERM process look like for a Project Superintendent hire?
Your employer first conducts a supervised recruitment campaign proving no qualified U.S. workers are available for the role. DOL then reviews the application and, if approved, certifies the labor condition. That certification goes to USCIS with an I-140 immigrant petition. From certified PERM to approved I-140 typically takes one to two years before you can file for adjustment of status.
How do I find employers who will sponsor a green card for a Project Superintendent position?
Search for Project Superintendent listings filtered by green card sponsorship history on Migrate Mate. The platform surfaces employers with verified PERM and I-140 filing records for construction management roles, so you can focus your applications on companies that have already navigated the sponsorship process rather than starting from scratch with an employer unfamiliar with PERM.
Can I start working in the U.S. while my green card application is pending?
Yes, if you're already in valid status such as H-1B or L-1 visa, you can continue working while your PERM and I-140 are pending. Once your I-485 adjustment of status application is filed and your priority date is current, you can also apply for an Employment Authorization Document through USCIS, which lets you work independently of your underlying visa status.
