Verify your MSW meets PERM requirements
PERM labor certification for social worker roles almost always requires a Master of Social Work. Confirm your foreign degree is evaluated as equivalent by a NACES-accredited credential evaluation agency before applying, since DOL audits frequently scrutinize educational equivalencies for this occupation.
Check your state license before applying
Most hospital and clinical social worker PERM filings list state licensure as a minimum requirement. Securing your LCSW or LMSW early strengthens your candidacy and prevents your employer from hitting a filing delay after the job offer is made.
Target employers with PERM filing history
Hospitals, federally qualified health centers, and large nonprofit agencies have established immigration infrastructure and are far more likely to sponsor green cards than small private practices. Use Migrate Mate to filter Social Worker jobs by employers with active EB-2 and EB-3 sponsorship history.
Ask about concurrent I-140 and I-485 filing
If a current visa priority date is available for your country, your employer can file the I-140 immigrant petition and your I-485 adjustment of status application at the same time, cutting months off your wait. Confirm this option with your employer's immigration counsel before accepting the offer.
Understand the PERM prevailing wage for your specialty
DOL sets four wage levels for PERM, and clinical or supervisory social worker roles often qualify at Level II or III. Use the OFLC Wage Search to look up the wage level your employer intends to file at, since a mismatch can draw an audit or require refiling.
Clarify EB-2 versus EB-3 before your offer letter
Employers can sponsor social workers under EB-2 if the role genuinely requires an advanced degree, or under EB-3 for roles where a bachelor's with experience suffices. The distinction affects your priority date and wait time, so confirm which category the employer's attorney will file under before you sign.

Find Social Worker JobsSocial Worker Green Card Sponsorship: Frequently Asked Questions
Do social worker jobs commonly qualify for EB-2 or EB-3 green card sponsorship?
Social worker roles qualify for both categories depending on the position's requirements. Clinical and supervisory roles that require a Master of Social Work typically fall under EB-2, since the position genuinely requires an advanced degree. Direct-service roles where a bachelor's degree with experience is sufficient are usually filed under EB-3. Your employer's immigration attorney determines the correct classification during PERM preparation.
How does green card sponsorship differ from H-1B sponsorship for social workers?
Green card sponsorship through PERM and I-140 leads to permanent residency, not a temporary status. Unlike the H-1B, there is no annual lottery for EB-3 filings, and the process isn't capped in the same way for most nationalities. The trade-off is timeline: PERM labor certification alone takes six to twelve months before the I-140 is even filed, making it a longer but more permanent path than an H-1B approval.
What does the PERM labor certification process require from a social work employer?
The employer must run a formal recruitment campaign documented by DOL standards, proving no qualified U.S. workers were available for the role. For social worker positions, job postings must list the actual minimum requirements, including degree and licensure, exactly as they'll appear in the PERM application. Any deviation between the recruitment ads and the filed application is grounds for an audit or denial.
How can I find social worker jobs where the employer is already set up to sponsor green cards?
The fastest way is to search specifically for employers with documented PERM and I-140 filing history in social work. Migrate Mate lets you filter Social Worker jobs by employers who have sponsored green cards before, so you're not spending time applying to organizations that have never navigated PERM. This matters especially in social services, where smaller nonprofits may be willing but lack the immigration infrastructure to execute.
Does holding a foreign social work degree affect my green card sponsorship eligibility?
A foreign MSW or equivalent degree is acceptable for EB-2 PERM filings, but it must be evaluated as equivalent to a U.S. degree by a NACES-accredited credential evaluation service. DOL audits for social worker PERM applications frequently examine educational credentials, so having your evaluation completed before your employer files reduces the risk of a request for further evidence or an audit response delay.
