Document your specialty occupation credentials early
Gather transcripts, professional engineering licenses, and project portfolios before applying. PERM requires your employer to prove your role demands a specific degree, so having credentials that match the posted job description prevents delays at the DOL stage.
Target employers with active PERM filing history
State DOTs, federal contractors, and large engineering consultancies file PERM applications regularly. Searching DOL disclosure data through Migrate Mate filters sponsoring Transportation Engineer employers by role and location, saving weeks of manual research.
Distinguish EB-2 from EB-3 before accepting an offer
EB-2 requires a master's degree or equivalent in civil or transportation engineering. If you hold a bachelor's plus five years of progressive experience, EB-3 is the practical route. Clarify which category your employer intends to file under before the job offer is finalized.
Confirm your employer's prevailing wage obligations
Your offered salary must meet or exceed the DOL prevailing wage for Transportation Engineers in your work location. Use the OFLC Wage Search to verify the wage level your employer plans to certify, and flag any gap before the PERM application is submitted.
Ask about the PERM recruitment timeline upfront
PERM requires employers to complete a mandatory recruitment period, typically six months from start to DOL filing. Understanding where your employer is in that process tells you how much of your own timeline is already consumed before I-140 can even be filed.
Verify your employer is E-Verify enrolled before the offer
Federal transportation contracts increasingly require E-Verify enrollment. If your role involves federal highway or infrastructure work, confirm your employer is enrolled before accepting, since unenrolled employers on federal contracts can lose their contracts mid-sponsorship.
Green Card Transportation Engineer: Frequently Asked Questions
Does a Transportation Engineer role qualify for EB-2 or EB-3 green card sponsorship?
Transportation Engineer roles typically qualify for both categories depending on your credentials. EB-2 applies if the position requires a master's degree or you hold a bachelor's plus five years of progressive specialized experience. EB-3 covers roles requiring a bachelor's degree in civil or transportation engineering. Your employer chooses the category when filing the PERM labor certification with DOL.
How does green card sponsorship differ from H-1B for Transportation Engineers?
Green card sponsorship through PERM, I-140, and adjustment of status leads to permanent residency rather than a temporary work authorization tied to a specific employer. Unlike H-1B visa, EB-3 green cards for most countries outside India and China face no meaningful annual cap wait, and EB-2 backlogs are shorter for rest-of-world applicants. The tradeoff is a longer total process, often 18 to 36 months from PERM filing to approval.
What does the PERM labor certification process look like for this role?
Your employer must conduct a mandatory recruitment process, advertise the Transportation Engineer position publicly, and demonstrate no qualified U.S. workers were available. DOL then reviews the application, which can take six to twelve months or longer depending on audit risk. Once certified, your employer files an I-140 petition with USCIS establishing your immigrant visa preference category and priority date.
How do I find Transportation Engineer employers who sponsor green cards?
Search Migrate Mate to filter Transportation Engineer job listings by employers with documented PERM and green card sponsorship history. State transportation agencies, federal contractors, and large consulting firms like those handling highway or rail infrastructure projects are the most consistent sponsors. Targeting employers who have filed previously reduces the risk of a sponsorship promise that never materializes.
Does a Professional Engineer license affect my green card eligibility?
A PE license strengthens your PERM case by reinforcing the specialty occupation argument, but it isn't required for EB-2 or EB-3 eligibility on its own. USCIS evaluates your degree field and the job's degree requirements rather than licensure. That said, roles requiring a PE for the position itself create a stronger specialty occupation argument, which can reduce Request for Evidence risk at the I-140 stage.
