Match your degree to the job
PERM requires your degree field to align with the VP of Operations role description. A general business or management degree typically qualifies, but an unrelated field can trigger a PERM denial even when your work history fits.
Target employers with PERM filing history
Search DOL PERM disclosure data to identify companies that have sponsored operations leaders before. Employers already familiar with the PERM recruitment process move faster and make fewer errors that stall your green card timeline.
Verify prevailing wage before negotiating salary
Your offer must meet or exceed the DOL prevailing wage for your exact job zone and location. Use the OFLC Wage Search before accepting any offer so you and your employer set compensation that satisfies PERM from day one.
Use Migrate Mate to filter sponsoring employers
Many VP of Operations openings never disclose green card sponsorship in the posting. Migrate Mate surfaces employers with verified EB-2 and EB-3 filing history for operations roles, so you spend time on realistic opportunities.
Clarify the EB-2 versus EB-3 path with your employer
VP of Operations roles can qualify under either EB-2 or EB-3 depending on how the employer defines minimum requirements. Confirm which category your employer intends to file under before signing an offer, since reclassifying later restarts the PERM clock.
Document your O*NET occupation code early
Your employer's PERM application must match the O*NET Standard Occupational Classification for your role. Confirm the correct code early and check that the job duties in your offer letter reflect O*NET's description for VP of Operations positions.
Green Card VP Of Operations: Frequently Asked Questions
Does a VP of Operations role qualify for EB-2 or EB-3 green card sponsorship?
VP of Operations positions typically qualify under EB-2 when the employer requires an advanced degree or equivalent, and under EB-3 when a bachelor's degree satisfies the minimum requirement. The employer defines the educational standard in the PERM job description, which determines the category. Your specific degree field and the duties listed in the offer letter both affect which classification USCIS will accept.
How does green card sponsorship differ from H-1B sponsorship for this role?
Green card sponsorship through PERM and I-140 leads to permanent residency rather than a temporary status with renewal cycles. Unlike H-1B visa, EB-2 and EB-3 have no annual lottery, so your petition is adjudicated on its merits. The tradeoff is timeline: PERM labor certification alone can take six to twelve months before USCIS even reviews the I-140, making early employer commitment essential for VP of Operations candidates.
What does the PERM process require from an employer sponsoring a VP of Operations?
Your employer must conduct a supervised recruitment campaign, advertise the position at the prevailing wage determined by DOL, and demonstrate that no qualified U.S. worker applied. For a VP of Operations role, the employer documents the job duties, minimum requirements, and wage offer in the PERM application. USCIS then reviews the I-140 only after DOL certifies the labor market test was properly conducted.
How can I find VP of Operations jobs where the employer is already open to green card sponsorship?
Most job postings do not disclose whether an employer will sponsor green cards. Migrate Mate filters companies by verified EB-2 and EB-3 PERM filing history, letting you target VP of Operations openings at employers who have already navigated the sponsorship process for similar roles rather than approaching employers cold.
Can I switch employers after my green card process has started?
Once your I-140 petition has been approved and your priority date is current, AC21 portability may let you change to a similar operations role without restarting the process. Before I-140 approval, changing employers generally requires the new employer to file a fresh PERM application, resetting your place in any backlog queue. Your immigration attorney can assess whether your duties qualify as same or similar under AC21.
