Map your degree to specialty occupation criteria
Market access roles require demonstrating that your degree directly aligns with the position. A graduate degree in health economics, public health, or business with a healthcare concentration strengthens your specialty occupation argument more than a general science background.
Use OFLC Wage Search before negotiating salary
DOL assigns prevailing wage levels to market access titles by geography and experience. Pull the Level III or Level IV wage for your metro area before accepting an offer so your compensation clears the LCA threshold and avoids a wage-based RFE.
Target employers with active payer strategy teams
Biopharma companies mid-launch or building formulary access infrastructure consistently hire at the Associate Director level and file H-1B petitions for these roles. Use Migrate Mate to filter for employers with verified H-1B LCA filing history in market access and health economics job codes.
Confirm your employer's E-Verify enrollment early
If you're on OPT STEM extension and transitioning to H-1B, your employer must be E-Verify enrolled for cap-gap protection to apply. Ask HR to confirm enrollment status before your OPT end date, not after the petition is filed.
Understand how cap-exempt employers affect your timeline
Some market access roles at academic medical centers or nonprofit hospital systems qualify for cap-exempt H-1B filings, letting you start without waiting for the October 1 effective date. Verify whether your prospective employer qualifies under USCIS cap-exempt criteria before comparing offer timelines.
Document payer negotiation outcomes as evidence of specialized knowledge
USCIS scrutinizes market access petitions when the job description reads as business development rather than specialized expertise. Quantify your formulary wins, value dossier development, or HEOR methodology experience in your support letter to establish the specialized knowledge standard.
H-1B Visa Associate Director Market Access: Frequently Asked Questions
Does an Associate Director Market Access role qualify as an H-1B specialty occupation?
Yes. Market access at the Associate Director level typically requires a master's degree or higher in health economics, pharmacy, public health, or a related field, which satisfies USCIS specialty occupation criteria. The role must demonstrably require that specific academic background, so your employer's job description should explicitly state degree requirements rather than list a degree as preferred.
Which industries sponsor H-1B visas most often for market access roles?
Biopharmaceutical manufacturers, medical device companies, and specialty pharmacy organizations are the most consistent H-1B sponsors for market access titles. Managed care organizations and healthcare consulting firms also file petitions for this role, particularly for positions focused on formulary strategy, HEOR, or value-based contracting. Browse verified sponsoring employers on Migrate Mate using market access job filters.
How does the prevailing wage requirement affect market access compensation?
DOL requires your employer to pay at least the prevailing wage for your specific role, experience level, and work location, as certified in the LCA. Associate Director titles typically fall at wage Level III or IV depending on supervisory scope and geographic market. You can verify applicable wage levels using the OFLC Wage Search tool before evaluating any offer.
Can I transfer my H-1B to a new market access employer mid-visa period?
Yes, H-1B portability allows you to start working for a new employer as soon as they file a transfer petition, without waiting for approval, provided you're maintaining valid status. The new employer must file a new LCA for the specific market access role and location. You don't need to restart the cap count if you've already been counted against the annual cap.
What evidence strengthens an H-1B petition for a market access position?
A strong petition includes a detailed job description tying each duty to a specific academic discipline, your academic credentials with transcripts, and a support letter explaining why a generalist degree wouldn't suffice. Evidence of payer negotiation experience, value dossier authorship, or HEOR methodology use helps establish specialized knowledge. An employer's prior LCA filings in the same occupation code also support the petition.
