Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Business Developer
Verify your degree supports specialty occupation
USCIS requires your degree field to directly relate to your Business Developer duties. A general business degree typically qualifies, but a degree in an unrelated field can trigger an RFE. Document the connection between your coursework and your job responsibilities before applying.
Target employers with active LCA filing history
Search Migrate Mate to identify companies that have filed LCAs for Business Developer roles. Employers who've sponsored similar positions before understand the process and are far less likely to withdraw an offer once filing begins.
Check prevailing wage before negotiating your offer
Your offer must meet or exceed the DOL prevailing wage for your job title and work location. Use the OFLC Wage Search to look up the wage level before salary discussions so you know the floor your employer is legally required to meet.
Confirm your role maps to a recognized occupation code
Business Developer isn't always a standard SOC code. Check O*NET to find the closest match for your actual duties. The SOC code your employer selects drives the prevailing wage calculation, so an incorrect mapping can affect both your offer and your petition.
Clarify the H-1B timeline with your employer early
Cap-subject H-1B petitions can only start employment on October 1 after a March lottery. If your employer expects you to start sooner, discuss whether they qualify as a cap-exempt entity or whether a bridge status like OPT is available to cover the gap.
Prepare for specialty occupation scrutiny in your offer letter
Business Developer titles attract RFEs because USCIS sometimes questions whether the role truly requires a degree. Ask your employer to describe duties in terms of analytical, strategic, and specialized business functions rather than generalist sales or relationship tasks.

Find Business Developer JobsBusiness Developer H-1B Visa: Frequently Asked Questions
Does a Business Developer role qualify as a specialty occupation for H-1B purposes?
It depends on how the role is defined. USCIS requires that the position normally requires at least a bachelor's degree in a specific specialty. Business Developer roles focused on strategic partnerships, market analysis, or technical sales in fields like software, biotech, or finance are more likely to qualify than generalist sales positions with no degree requirement.
How do I find employers who have sponsored H-1B visas for Business Developer roles before?
Migrate Mate filters job listings by verified H-1B sponsorship history, so you can target companies that have already filed LCAs for Business Developer or closely related roles. This is more reliable than asking employers directly, since many HR teams don't know their own filing history off the top of their head.
Can my employer file an H-1B for a Business Developer role with a commission-based pay structure?
Yes, but the base salary must meet or exceed the DOL prevailing wage for the role and location. Commission on top of that base is fine. USCIS and DOL require that the guaranteed wage component alone satisfies the prevailing wage, so an all-commission or heavily variable structure typically won't clear the LCA.
What happens if USCIS issues an RFE on my Business Developer H-1B petition?
An RFE isn't a denial. It means USCIS needs more evidence that the role qualifies as a specialty occupation. Your employer's attorney will typically respond with your job description, your employer's hiring history for similar roles, and documentation showing that a degree in a specific field is standard for the position in your industry.
Does the SOC code my employer uses for the LCA affect my H-1B approval odds?
Yes. The SOC code determines the prevailing wage tier and signals to USCIS how to evaluate the specialty occupation requirement. Business Developer roles are sometimes filed under codes like Business Development Manager or Sales Manager. The O*NET profile for the selected code should closely match your actual duties, or the petition is more vulnerable to an RFE.
