Verify your credential meets specialty occupation
USCIS evaluates whether your CST role requires a bachelor's degree or higher. An associate degree plus NBSTSA certification strengthens your case, but your employer's job posting must state a specific degree field as required, not preferred.
Pull LCA data before you apply
Use Migrate Mate to filter Certified Surgical Technologist roles by employers with verified H-1B LCA filing history. This cuts out surgical centers that have never filed and focuses your applications on proven sponsors.
Target teaching hospitals and Level I trauma centers
Academic medical centers and trauma-designated hospitals file H-1B petitions far more regularly than small outpatient surgery clinics. They have dedicated HR and legal teams familiar with the sponsorship process for clinical support roles.
Confirm prevailing wage tier before accepting an offer
Use the OFLC Wage Search to look up the CST prevailing wage in your specific metro area. Your offer must meet at least Level I. A low offer can cause a DOL certification issue before the petition even reaches USCIS.
Get your credentials evaluated before the petition
If you trained outside the U.S., submit a credential evaluation through a NACES-member organization before your employer files the I-129. USCIS requires evidence your foreign degree is equivalent to a U.S. bachelor's in a relevant health science field.
Clarify who covers filing fees before signing
USCIS prohibits employers from passing certain H-1B filing fees onto you. Confirm in writing whether your employer covers base filing fees, and negotiate premium processing coverage to reduce your waiting period to 15 business days.

Find Certified Surgical Technologist JobsCertified Surgical Technologist H-1B Visa: Frequently Asked Questions
Does a Certified Surgical Technologist role qualify as a specialty occupation for H-1B?
It can, but the employer's job description carries significant weight. USCIS looks for roles that normally require a bachelor's degree or higher in a specific field. Many CST postings list an associate degree as sufficient, which can undermine a specialty occupation argument. Employers strengthen their case by specifying a degree requirement in surgical technology, health sciences, or a related field and documenting why the role demands that level of education.
Which types of employers most commonly sponsor H-1B visas for surgical technologists?
Teaching hospitals, Level I and II trauma centers, Veterans Affairs medical centers, and large regional health systems file H-1B petitions for CST roles most consistently. Ambulatory surgery centers and small specialty clinics occasionally sponsor but less frequently. Use Migrate Mate to browse Certified Surgical Technologist openings filtered by employers with active H-1B LCA filing history so you spend time on realistic targets.
Can my employer use cap-exempt status to file my H-1B petition?
Yes, if your employer qualifies. Nonprofits affiliated with universities, government research organizations, and certain higher education institutions are exempt from the annual H-1B cap and lottery. Many academic medical centers and VA facilities meet this threshold. If your surgical technologist role is at a cap-exempt institution, your employer can file anytime and you skip the lottery entirely, which dramatically shortens your path to approval.
Does NBSTSA certification help or replace the degree requirement for H-1B purposes?
NBSTSA certification demonstrates professional competency but does not substitute for degree requirements under USCIS specialty occupation rules. However, it does support the argument that the position requires specialized knowledge. Employers often pair certification documentation with evidence of industry-wide degree norms, such as job postings from comparable institutions, to build a stronger specialty occupation record in the I-129 petition.
What happens to my H-1B status if my hospital undergoes a merger or acquisition?
A qualifying merger or acquisition can allow your H-1B status to transfer to the successor employer without a new petition, provided your job duties and compensation remain substantially the same. The successor employer assumes the original employer's obligations and must notify USCIS. If duties or title change significantly, a new I-129 petition is required. Confirm with your employer's immigration counsel as soon as a transaction is announced.
