Verify your role meets specialty occupation
H-1B requires the position to demand at least a bachelor's degree or its equivalent. Pull the O*NET profile for Chef De Partie and confirm your employer's job description ties the role to a specific culinary discipline, not general kitchen duties.
Build an equivalency portfolio for culinary credentials
A four-year culinary degree isn't always available in every country. Document three years of progressive kitchen experience per missing degree year, and get a credential evaluation from a NACES-member organization before USCIS reviews your petition.
Target employers with active LCA filing history
Use Migrate Mate to filter Chef De Partie roles by employers who have filed Labor Condition Applications for culinary positions, so you're applying where H-1B sponsorship is already part of the hiring process, not a new ask.
Ask about the LCA wage level during negotiations
DOL requires your employer to certify your wage against the prevailing rate for your metro area. Cross-check the offered wage against the OFLC Wage Search before signing an offer letter to avoid a petition filed at a wage that triggers an RFE.
Confirm E-Verify enrollment before accepting an offer
Some hotel and resort groups operate multiple legal entities. The specific entity extending your offer must be enrolled in E-Verify and listed on your LCA. Ask HR to confirm which entity is sponsoring you before your employer files Form I-129.
Plan around the October 1 start date for cap-subject filings
If your employer is cap-subject, your H-1B can't start before October 1 of the fiscal year. Hotel and restaurant groups with timing-sensitive kitchen staffing need to factor this into your onboarding, especially for seasonal openings.
H-1B Visa Chef De Partie: Frequently Asked Questions
Does a Chef De Partie role actually qualify for H-1B sponsorship?
It can, but the job description has to establish that the role requires specialized culinary knowledge at a degree level, not just cooking experience. A generic line cook position won't qualify. Fine dining establishments and luxury hotel groups typically write Chef De Partie job descriptions that meet USCIS specialty occupation standards by requiring formal culinary education in a specific discipline.
What if my culinary training came from a two-year program, not a four-year degree?
USCIS accepts combinations of education and work experience as equivalent to a bachelor's degree. The standard is three years of progressive, specialized experience for each missing year of education. A two-year culinary diploma plus six years of documented station-specific kitchen experience can satisfy the requirement if your employer's petition explains the equivalency clearly.
Which types of employers sponsor H-1B visas for Chef De Partie roles?
Luxury hotel chains, high-end resort operators, Michelin-recognized restaurant groups, and large hospitality management companies are the most consistent H-1B sponsors for this role. Independent restaurants rarely go through the process. You can browse active Chef De Partie roles at verified sponsoring employers on Migrate Mate, filtered by employers with LCA filing history.
How does prevailing wage work for a Chef De Partie H-1B petition?
Your employer must certify with DOL that your wage meets the prevailing rate for Chef De Partie in your specific metro area. Wage levels run from Level 1 (entry) to Level 4 (expert), and your job duties determine which level applies. A Level 1 petition for a role with supervisory responsibilities is a common RFE trigger. Check the OFLC Wage Search to see the applicable range before your employer files.
Can I change employers while on H-1B as a Chef De Partie?
Yes, and you can start with the new employer as soon as they file a transfer petition, without waiting for approval, under AC21 portability rules. The new employer must be H-1B eligible, file Form I-129 with the correct wage documentation, and obtain a new certified LCA from DOL before or alongside the petition filing. Your status transfers on the receipt notice date.
