Verify your credentials meet RD requirements
USCIS requires proof that your role is a specialty occupation. Having a Registered Dietitian credential from the Commission on Dietetic Registration strengthens your petition by tying your foreign degree to a U.S.-recognized professional standard.
Target healthcare systems with cap-exempt status
Hospitals affiliated with universities or nonprofit research institutions can file H-1B petitions year-round without entering the lottery. Prioritize these employers early; their HR teams are usually experienced with the full sponsorship process.
Check prevailing wage before negotiating your offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your location and job level. Use the OFLC Wage Search to look up Level I through Level IV wages for your metro area before your offer discussion.
Search employer LCA filing history on Migrate Mate
Filter by occupation code on Migrate Mate to see which healthcare employers have filed LCAs for dietitian roles. This shows you who has sponsored before, so you spend your applications on employers with a real track record.
Clarify who pays the I-129 filing fees upfront
USCIS prohibits employers from deducting the H-1B petition filing fee from your wages. Confirm in writing before signing that your employer covers the I-129 fee, and ask whether they'll pay for premium processing to shorten the timeline.
Prepare for the specialty occupation RFE risk
Some USCIS officers issue Requests for Evidence challenging whether a dietitian role requires a specific degree. Have your employer document why a nutrition or dietetics degree is essential to the position, not just preferred, in the job description.
H-1B Visa Clinical Dietitian: Frequently Asked Questions
Does a Clinical Dietitian role qualify as an H-1B specialty occupation?
Yes. USCIS considers Clinical Dietitian positions specialty occupations because the role requires at minimum a bachelor's degree in dietetics, nutrition, food science, or a closely related field. The O*NET occupation profile for dietitians lists a master's degree as typical, which further supports the specialty occupation argument in your petition.
Which types of employers sponsor H-1B visas for dietitians?
Hospital systems, integrated health networks, long-term care facilities, and university-affiliated medical centers are the most active sponsors. Nonprofit hospitals and those attached to academic institutions are particularly valuable because they're often cap-exempt, meaning they can file your H-1B petition at any point in the year without waiting for the annual lottery.
How do I find employers who have sponsored H-1B visas for Clinical Dietitians?
Search Migrate Mate by occupation code to see verified employer LCA filing history for dietitian roles. This lets you filter specifically for healthcare employers who have filed for this job title before, so you're targeting organizations that already understand the sponsorship process rather than asking unfamiliar HR teams to navigate it from scratch.
What happens to my H-1B status if I change healthcare employers?
You can transfer your H-1B to a new employer under H-1B portability, as long as you file the new I-129 petition while your current status is still valid and you've been in H-1B status for at least 180 days. You can begin working for the new employer as soon as USCIS receives the transfer petition, not just after approval.
Does holding a Registered Dietitian credential help my H-1B petition?
Having the RD credential from the Commission on Dietetic Registration strengthens your case significantly. It demonstrates to USCIS that your role meets a nationally recognized professional standard tied to your degree. Employers also typically require it for clinical roles, so the credential aligns your job offer with the specialty occupation definition USCIS looks for.
