Verify your ABPN board certification pathway
H-1B petitions for epileptologists frequently cite board certification as evidence of specialty occupation status. Confirm whether your clinical neurophysiology or epilepsy fellowship meets ABPN eligibility requirements before your employer files the I-129.
Target Level 4 epilepsy centers specifically
NAEC-designated Level 3 and Level 4 epilepsy centers run dedicated fellowship and attending pipelines and file H-1B petitions routinely. Academic medical centers affiliated with neurology residency programs are far more practiced at sponsoring subspecialists than community hospitals.
Search LCA filings to identify active sponsors
Use Migrate Mate to filter employers by H-1B LCA filing history for neurology and epileptology roles. This surfaces which academic centers and health systems have actively sponsored the position, saving you from pursuing employers with no sponsorship infrastructure.
Use OFLC Wage Search before negotiating your offer
Your employer must certify your salary meets the DOL prevailing wage for your SOC code and location. Run the OFLC Wage Search for neurologists in your target metro before finalizing your offer letter so you know the minimum wage floor your employer must clear.
Align your fellowship end date with the H-1B cap timeline
If you're completing a fellowship on J-1 or F-1 OPT, the H-1B cap filing opens April 1 for an October 1 start. Work with your program director early to confirm your end date doesn't create a gap if your cap-subject petition isn't selected in the lottery.
Request cap-exempt filing through a hospital outpatient clinic
Epileptologists employed by nonprofit hospitals or university medical centers may qualify for cap-exempt H-1B filing, bypassing the lottery entirely. Ask your prospective employer's legal team whether their entity qualifies under INA 214(g)(5)(A) before assuming you need lottery selection.

Find Epileptologist JobsEpileptologist H-1B Visa: Frequently Asked Questions
Does the epileptologist role qualify as a specialty occupation for H-1B purposes?
Yes. Epileptology requires a medical degree followed by neurology residency and an accredited epilepsy or clinical neurophysiology fellowship, satisfying USCIS's requirement that the position normally requires at least a bachelor's degree in a specific specialty. USCIS has consistently approved H-1B petitions for neurologist subspecialties, and the theoretical and practical application of highly specialized knowledge is well-documented for this role.
Which types of employers most commonly sponsor H-1B visas for epileptologists?
Academic medical centers, university-affiliated hospitals, and NAEC-designated Level 3 and Level 4 epilepsy programs are the most active sponsors. These institutions have established immigration infrastructure and regularly file H-1B petitions for subspecialty neurologists. Private neurology groups and community hospitals sponsor less frequently and may lack the administrative experience to manage the filing process efficiently. You can filter by employer filing history on Migrate Mate.
Can an epileptologist on J-1 waiver status transition to H-1B?
Yes, but the pathway depends on your waiver type. Conrad 30 waivers typically require you to work in a designated shortage area for three years before changing status. IGA and federal agency waivers have their own conditions. Once your waiver obligation is fulfilled, your employer can file a change of status to H-1B, or you can pursue cap-exempt filing if the employer qualifies as a nonprofit or government research institution.
How does the H-1B cap lottery affect epileptologists seeking their first U.S. employer sponsor?
If your prospective employer is a for-profit entity without cap-exempt status, your petition enters the annual H-1B lottery capped at 85,000 slots. Registrations open in March for an October 1 start date. However, nonprofit hospitals and university medical centers are cap-exempt, meaning they can file at any time of year without lottery selection, which significantly reduces timing risk for epileptologists transitioning from fellowship.
What should I verify about an employer's H-1B sponsorship process before accepting an offer?
Confirm whether the employer is cap-subject or cap-exempt, who covers legal and filing fees, and whether they use an in-house immigration team or outside counsel. Ask specifically about premium processing availability, since epilepsy program start dates are often tied to academic calendars. You can check a prospective employer's LCA filing history for neurology roles before your interview by searching on Migrate Mate.
