Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Clinical Registered Nurse
Get your credentials verified before applying
Most H-1B-sponsoring hospitals require CGFNS credential evaluation or state board equivalency review before they'll initiate an LCA. Start this process early, it can take two to four months and stalls offers without it.
Target health systems with active LCA filings
Use Migrate Mate to filter Clinical Registered Nurse roles by employers with verified H-1B Labor Condition Application history, so you're applying only to organizations that have actually sponsored this occupation before.
Verify the prevailing wage tier before negotiating
Your offered salary must meet the DOL prevailing wage for your specific nursing specialty and work location. Run the OFLC Wage Search before accepting an offer to confirm the employer's number clears the threshold for your job zone.
Ask HR explicitly about cap-subject versus cap-exempt status
Nonprofit hospitals and university health systems are often cap-exempt, meaning your H-1B can be filed any time without waiting for the April lottery. Cap-exempt sponsorship is a concrete advantage worth confirming upfront with the recruiter.
Account for state licensure in your filing timeline
USCIS requires an active state RN license before approving the H-1B petition. If you're relocating, the new state's licensure endorsement process can take four to ten weeks and must finish before your employer files Form I-129.

Find Clinical Registered Nurse JobsClinical Registered Nurse H-1B Visa: Frequently Asked Questions
Does a Clinical Registered Nurse role qualify as an H-1B specialty occupation?
Yes, provided the position specifically requires a BSN or higher in nursing. USCIS evaluates each petition individually, so the job description must state the degree requirement explicitly. Roles that accept an associate degree or list a BSN as preferred rather than required are unlikely to survive adjudication as specialty occupations.
Which types of employers sponsor H-1B visas for RNs?
Large hospital systems, academic medical centers, Veterans Affairs facilities, and some long-term care networks are the most active H-1B sponsors for Clinical Registered Nurses. Nonprofit and university-affiliated hospitals are frequently cap-exempt, which removes the lottery requirement entirely. You can search for employers with verified LCA filing history for nursing roles on Migrate Mate.
Do I need my state nursing license before my employer files the H-1B petition?
Yes. USCIS requires proof of an active, valid RN license in the state where you'll work before it will approve Form I-129. If you're relocating for the role, your employer should build the endorsement timeline into the petition schedule. Delays in licensure transfer directly delay the filing and your start date.
How does the H-1B cap and lottery affect RN sponsorship?
H-1B-subject petitions enter the annual lottery, which opens in March for an October 1 start date. However, many hospitals that sponsor nurses are cap-exempt under INA Section 214(g)(5) because they're nonprofits or university affiliates. A cap-exempt employer can file your H-1B petition at any point during the year with no lottery risk.
What is the typical H-1B filing process for a Clinical Registered Nurse?
Your employer files a Labor Condition Application with DOL first, certifying your offered wage meets the prevailing wage for your nursing specialty and location. Once the LCA is certified, they file Form I-129 with USCIS. You'll need an active state license, credential evaluation, and a BSN or higher. Standard processing takes several months; premium processing is available for faster adjudication.
