Verify your degree meets specialty occupation
USCIS requires H-1B roles to need at minimum a bachelor's degree in a specific field. For Social Work Assistant positions, your degree must be in social work, psychology, counseling, or human services. A general liberal arts degree may trigger an RFE.
Search LCA filings for this exact job title
Use the OFLC Wage Search to filter Labor Condition Application filings by SOC code 21-1029 or job title. This reveals which healthcare networks and government contractors have actually sponsored this role, not just which ones claim to be open to sponsorship.
Target healthcare systems over small nonprofits
Large hospital networks and federally qualified health centers file H-1B petitions regularly and have established HR processes for sponsorship. Smaller community nonprofits often lack the infrastructure to file, even when they're willing in principle.
Use Migrate Mate to filter verified sponsoring employers
Migrate Mate surfaces employers with confirmed H-1B LCA filing history for social services roles, so you're not applying to organizations that have never sponsored. Filter by occupation code to see active filings specific to Social Work Assistant positions.
Negotiate LCA filing into your offer timeline
Your employer must file and receive a certified LCA from DOL before submitting your H-1B petition to USCIS. DOL typically certifies within seven business days, but confirm your start date accounts for this step plus USCIS processing time.
Check state licensure requirements before you file
Several states require Social Work Assistants to hold a state license or registration. USCIS may scrutinize petitions for roles with inconsistent licensure requirements across states, so confirm whether your work location requires credentials beyond your degree.
H-1B Visa Social Work Assistant: Frequently Asked Questions
Does a Social Work Assistant role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. USCIS requires the job to normally require at least a bachelor's degree in a specific field. If the posting specifies a degree in social work, psychology, counseling, or human services as a minimum requirement, it can qualify. Employers who list a degree as preferred rather than required create a weaker petition and face higher RFE risk.
Which types of employers sponsor H-1B visas for Social Work Assistant jobs?
Healthcare systems, hospital networks, federally qualified health centers, and county human services agencies are the most consistent sponsors for this role. Academic medical centers also file for this occupation. You can browse employers with confirmed LCA filing history for social services roles on Migrate Mate, which filters by verified DOL filings rather than self-reported sponsorship policies.
How does the H-1B cap affect Social Work Assistant job seekers?
Most Social Work Assistant employers are cap-subject, meaning your petition enters the annual H-1B lottery capped at 85,000 slots. However, if you work for a nonprofit affiliated with a university or a government research organization, that employer may be cap-exempt, allowing your petition to be filed at any time without entering the lottery. Confirm your employer's cap status before accepting an offer.
Can my employer file an H-1B petition if I'm currently on OPT?
Yes. If your OPT is still active when your employer files during the April registration window, and you're selected in the lottery, cap-gap protections extend your work authorization through September 30 while USCIS adjudicates. Your employer needs a certified LCA from DOL before filing the I-129 petition. Confirm your OPT end date against the expected petition timeline so there's no gap in authorization.
What prevailing wage level applies to Social Work Assistant H-1B filings?
DOL assigns prevailing wages by SOC code, job duties, and geographic location. Social Work Assistant roles typically fall under SOC code 21-1029. You can look up the applicable wage tier using the OFLC Wage Search tool. Your employer must certify in the LCA that they'll pay at least the prevailing wage for your location and experience level. Wages vary significantly between urban and rural areas, so check the rate specific to your work site.
