Verify your MSW meets specialty occupation standards
H-1B eligibility for clinical social work turns on whether the role requires a specific MSW or higher. Pull the O*NET profile for Social Workers to document the degree requirement before your employer files the petition.
Prioritize employers with active LCA filing history
Search Migrate Mate to filter Clinical Social Worker roles by employers who have filed Labor Condition Applications for this occupation. That history confirms the employer understands H-1B obligations and has done it before.
Obtain state licensure before the petition is filed
Most hospital and healthcare system sponsors require you to hold or be eligible for your state clinical license before filing Form I-129. Check your target state's licensing board requirements early since supervised hours and exam eligibility vary significantly.
Confirm the prevailing wage covers your offered salary
Your employer must certify in the LCA that your salary meets the DOL prevailing wage for Clinical Social Workers in your work location. Run the OFLC Wage Search yourself using SOC code 21-1022 to verify the Level I or II wage before negotiating your offer.
Target cap-exempt employers to avoid the lottery
Nonprofits affiliated with universities, government research hospitals, and federally qualified health centers are cap-exempt under USCIS rules. These employers can file an H-1B petition any time of year, bypassing the annual April lottery entirely.
Request premium processing if your start date is fixed
USCIS offers 15-business-day adjudication through premium processing on Form I-907. If your clinical license or a program's credentialing cycle ties you to a specific start date, ask your employer to include premium processing in the filing.
H-1B Visa Clinical Social Worker: Frequently Asked Questions
Does a Clinical Social Worker role qualify as an H-1B specialty occupation?
Yes, provided the employer requires an MSW or higher for the specific position. USCIS evaluates specialty occupation status at the job level, not just the field. Roles where a bachelor's degree in any discipline would be accepted don't meet the threshold, so your offer letter and job description must specify the MSW requirement explicitly.
Do I need a clinical license before my employer sponsors my H-1B?
Most healthcare and hospital employers require you to hold or be eligible for state clinical licensure before they'll initiate the LCA and I-129 filing. Licensing timelines vary by state and depend on your supervised hours and exam eligibility. Start the licensure application in parallel with your job search so you're not holding up the petition.
Which types of employers sponsor H-1B visas for Clinical Social Workers?
Hospitals, behavioral health systems, federally qualified health centers, VA facilities, university-affiliated counseling centers, and nonprofit community mental health agencies are the most consistent sponsors for this role. Many of these are cap-exempt, which means they can file outside the April lottery window. Browse employers with Clinical Social Worker LCA filings on Migrate Mate to narrow your search.
How does the DOL prevailing wage apply to Clinical Social Worker H-1B petitions?
Your employer must certify in the Labor Condition Application that your offered salary equals or exceeds the DOL prevailing wage for your occupation and work location. The relevant SOC code is 21-1022. You can verify the applicable wage tier using the OFLC Wage Search before accepting an offer to confirm the salary your employer is proposing is LCA-compliant.
Can I switch Clinical Social Worker employers while on H-1B status?
Yes. H-1B portability under AC21 lets you start working for a new employer once they file a non-frivolous I-129 petition on your behalf, as long as your prior H-1B was approved and you've maintained valid status. Your new employer must file their own LCA and I-129. Your clinical license must also be valid in the new work state if you're relocating.
