Verify your degree meets specialty occupation standards
H-1B approval for Nursing Technician roles depends on the position requiring at least a bachelor's degree in a specific health sciences field. Pull the O*NET profile for your job code to confirm the education benchmark before applying.
Target hospital systems with E-Verify enrollment
Facilities enrolled in E-Verify are structurally set up to hire international workers and are more likely to have HR teams familiar with H-1B filing. Filter your search to health systems with active LCA filings on Migrate Mate.
Request the prevailing wage tier before negotiating
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your role and location. Use OFLC Wage Search to look up the Level I through IV wage tiers for your specific metro area before your offer discussion.
Clarify cap-exempt status with academic medical centers
Nursing Technician roles at nonprofit teaching hospitals or university health systems may qualify as cap-exempt, meaning your employer can file H-1B petitions outside the annual lottery window at any time of year. Ask HR directly whether the facility holds cap-exempt status.
Time your credential evaluation before the lottery opens
USCIS requires foreign educational credentials to be evaluated as equivalent to a U.S. bachelor's degree. Submit your transcripts to a NACES-approved evaluator at least eight weeks before registration opens in March to avoid delays.
H-1B Visa Nursing Technician: Frequently Asked Questions
Does a Nursing Technician role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer defines the position. If the role requires a bachelor's degree or higher in nursing, health sciences, or a directly related clinical field as a minimum entry requirement, it qualifies. Roles where an associate degree or vocational certification is accepted as sufficient will not meet the specialty occupation standard, regardless of what you personally hold.
Which types of employers sponsor H-1B visas for Nursing Technician roles most consistently?
Large hospital networks, academic medical centers, and VA-affiliated facilities file the highest volume of H-1B petitions for clinical support roles. Specialty units such as ICU, NICU, and surgical services tend to have degree requirements that satisfy the specialty occupation threshold. You can filter employers by LCA filing history on Migrate Mate to identify which facilities have sponsored this role in your target city.
Can my employer file an H-1B petition for a Nursing Technician role outside the annual lottery?
Yes, if the employer qualifies as cap-exempt. Nonprofit research organizations, institutions of higher education, and affiliated nonprofit entities can file H-1B petitions at any time of year without entering the lottery. Many teaching hospitals and university health systems hold this status. Ask the HR or legal team directly whether the facility is cap-exempt before timing your application.
How does the prevailing wage requirement affect H-1B sponsorship for this role?
Your employer must file a Labor Condition Application with DOL certifying that your offered wage meets or exceeds the prevailing wage for your job title, experience level, and work location. The wage is divided into four levels based on complexity and supervision. You can look up the applicable level for your metro area using OFLC Wage Search before you receive a formal offer so you enter negotiations with accurate benchmarks.
What happens to my H-1B status if I change employers or units within the same hospital system?
Transferring to a new employer requires a new H-1B petition through USCIS portability rules, though you can start working for the new employer once the petition is received rather than waiting for approval. Moving between units within the same legal employer entity generally does not require a new petition, but a material change in duties or location may require an amended filing. Confirm the specifics with your employer's immigration counsel before any move.
