H-1B Visa Orthopedic Surgeon Jobs
Orthopedic surgeons qualify as H-1B visa specialty occupation workers, and most hospital systems and orthopedic groups actively sponsor because the physician shortage makes domestic hiring alone insufficient. Your path from foreign medical graduate to H-1B status runs through residency match, state licensure, and an employer-filed petition, no lottery exemption, but cap-exempt hospital employment is common.

Verify your ECFMG certification before applying
USCIS requires Educational Commission for Foreign Medical Graduates certification as evidence of specialty occupation eligibility for foreign-trained physicians. Without it, your employer's H-1B petition will face an immediate Request for Evidence that delays your start date.
Target cap-exempt hospital employers first
Hospitals affiliated with universities or nonprofits conducting research are cap-exempt under INA, meaning you skip the annual H-1B lottery entirely. Academic medical centers and teaching hospitals, not private practices, are your fastest path to an approved petition.
Use Migrate Mate to filter employers by LCA filing history
Orthopedic surgery LCA filings in DOL disclosure data tell you which hospital systems and orthopedic groups have consistently sponsored H-1B physicians. Migrate Mate surfaces that filing history by role, so you're applying to employers with a documented track record, not guessing.
Confirm state medical board licensure timelines early
H-1B petitions for physicians require a full, unrestricted state medical license before USCIS will approve the petition in most cases. Some states take four to six months to process orthopedic surgeon applications, so start the licensing process well before your employer files.
Check prevailing wage levels using OFLC Wage Search
DOL sets four prevailing wage levels for orthopedic surgeons by geography. Your offered salary must meet at least Level I before your employer can file the Labor Condition Application. Pull the current figures from OFLC Wage Search before you negotiate your offer.
Negotiate premium processing into your offer letter
USCIS premium processing reduces adjudication to 15 business days. For orthopedic surgeons with a defined practice start date, ask the employer to include premium processing in the offer terms before you sign, retrofitting it later adds friction and cost to the employer's legal team.
H-1B Visa Orthopedic Surgeon: Frequently Asked Questions
Does orthopedic surgery qualify as an H-1B specialty occupation?
Yes. Orthopedic surgery requires a medical degree, ECFMG certification for foreign graduates, residency completion, and state licensure, all of which satisfy USCIS's specialty occupation standard requiring at least a bachelor's degree in a directly related field. The role's educational requirements are set by statute and licensing boards, which makes it one of the more straightforward specialty occupation determinations USCIS processes.
Can I work at a hospital that is exempt from the H-1B cap?
Many hospital employers qualify as cap-exempt if they are affiliated with a university, are themselves a nonprofit, or conduct qualifying research. Cap-exempt status means your employer can file your H-1B petition at any time of year without entering the annual lottery. Confirm cap-exempt status with your prospective employer's legal team before accepting an offer, since not every hospital system qualifies.
How do I find orthopedic surgery employers who actively sponsor H-1B visas?
Migrate Mate filters employers by verified DOL Labor Condition Application filing history, so you can see which orthopedic groups and hospital systems have an active H-1B sponsorship track record for physician roles. This is more reliable than asking at interviews, since LCA filings are public record and reflect actual sponsorship behavior rather than stated policy.
Does my J-1 waiver status affect my H-1B eligibility as an orthopedic surgeon?
If you completed a J-1 visa-funded residency or fellowship, you're typically subject to a two-year home residency requirement before changing to H-1B status unless you obtain a waiver. Conrad 30 waivers are the most common path for physicians, often tied to underserved area service commitments. USCIS will not approve your H-1B petition until the J-1 obligation is resolved or waived.
What documentation does my employer need to file my H-1B petition?
Your employer needs your ECFMG certificate, medical school transcripts and diploma, residency completion documentation, and your current state medical license. They'll file a Labor Condition Application with DOL before submitting Form I-129 to USCIS. You'll also need to provide your CV, any prior immigration filings, and passport copies. The employer's immigration attorney typically coordinates document collection.
