Verify your degree meets specialty occupation
USCIS requires your degree field to directly correspond to Construction Supervisor duties. A construction management or civil engineering degree typically satisfies this. A general business degree often doesn't, so get a credential evaluation before applying.
Search LCA filings by occupation code
Use the OFLC Wage Search and filter by the SOC code for construction supervisors to see which employers have filed LCAs for this role. This tells you who has sponsored the position before, not just who claims to sponsor visas.
Target OSHA-regulated commercial contractors
Large commercial general contractors and infrastructure firms operate under federal compliance frameworks that make H-1B sponsorship procedurally familiar to their HR teams. Municipal and federal project contractors are especially consistent filers. Use Migrate Mate to filter for employers with verified LCA history in construction supervision.
Confirm the prevailing wage tier before accepting an offer
Your offered salary must meet the DOL prevailing wage for your specific level and metro area. Ask the employer which wage level they're filing at. Level I or II filings for supervisory roles can draw USCIS scrutiny if duties look more senior.
Ask employers about project-based work and LCA amendments
Construction Supervisors often move between job sites. Each new worksite in a different metropolitan statistical area may require a new LCA or amended posting. Confirm your employer understands this obligation before you sign, since non-compliance creates status risk for you.
File during cap season with premium processing
If you're outside the U.S. or changing status, your employer must file during the H-1B cap registration window each March. USCIS premium processing cuts adjudication to 15 business days, which matters when a project start date is fixed and you can't afford a delayed approval.

Find Construction Supervisor JobsConstruction Supervisor H-1B Visa: Frequently Asked Questions
Does a Construction Supervisor role qualify as a specialty occupation for H-1B purposes?
It depends on how the employer frames the position. If the role requires at minimum a bachelor's degree in construction management, civil engineering, or architecture and the job duties reflect that requirement, USCIS will typically recognize it as a specialty occupation. Generalist site supervisor roles without a degree requirement often don't qualify. The job description and degree requirement language in the LCA are what USCIS scrutinizes most closely.
Which employers sponsor H-1B visas for Construction Supervisor positions?
Commercial general contractors, engineering and construction firms on large-scale federal or infrastructure projects, and international construction companies with U.S. operations are the most consistent H-1B filers for this role. You can identify them by reviewing DOL LCA disclosure data filtered by occupation. Migrate Mate surfaces employers with verified LCA filing history for construction supervision roles, so you're not guessing based on company size alone.
Can I transfer my H-1B to a new construction employer mid-project?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as the new I-129 petition is filed, without waiting for approval, as long as your previous H-1B was approved and you've maintained valid status. The new employer must file a new LCA and I-129 before your first day. If your role involves multiple worksites, the new employer also needs to handle site-specific LCA posting requirements from day one.
How does working across multiple job sites affect my H-1B status?
Each worksite in a different metropolitan statistical area requires its own LCA posting, and in some cases a new LCA filing with DOL. Short-term placements under 30 days at a location outside your primary worksite have lighter requirements, but anything longer triggers the standard LCA process. This is a compliance area many construction employers mishandle, so it's worth confirming your employer's process before accepting a role that involves regular site rotation.
Is a construction management bachelor's degree from outside the U.S. accepted for H-1B purposes?
Yes, foreign degrees are accepted, but they must be evaluated by a credential evaluation service to confirm equivalency to a U.S. bachelor's degree. A three-year degree may or may not be accepted as equivalent depending on the evaluator's assessment and the country of origin. USCIS relies on that evaluation when adjudicating the specialty occupation requirement, so using an accredited evaluator recognized in the industry is important before your employer files.
