Get Access To All JobsTips for Finding H-1B Visa Sponsorship in COO
Verify your degree aligns with the role
USCIS requires your degree field to directly relate to the COO position. A general business or MBA degree typically satisfies this, but an unrelated field may trigger a Request for Evidence. Pull your credential evaluation before interviews.
Target companies with cap-exempt filing pathways
COO roles at universities, nonprofit research institutions, or government-affiliated entities qualify for cap-exempt H-1B petitions, bypassing the annual lottery. Prioritize these employers if you've already used one H-1B slot or missed the cap window.
Search H-1B sponsors on Migrate Mate
Use Migrate Mate to filter COO-level openings by employers with verified H-1B LCA filing history, so you're only applying to companies that have actively sponsored similar roles, not ones guessing at the process.
Benchmark your offer against OFLC Wage Search
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your job title and location. Run the OFLC Wage Search before negotiating your offer to confirm the number meets the legal floor for your metro area.
Clarify equity compensation in your H-1B petition
COO offers frequently include equity. USCIS requires your certified wage to cover base salary alone, not stock. Confirm your base pay meets the LCA threshold independently so vesting schedules don't create a compliance gap at renewal.
File premium processing if your start date is firm
USCIS premium processing cuts the adjudication window to 15 business days. For COO hires where boards and investors expect a specific start date, ask your employer to include it with the initial I-129 filing rather than upgrading later.
H-1B Visa COO: Frequently Asked Questions
Does a COO role qualify as a specialty occupation for H-1B purposes?
Yes, if the position normally requires at least a bachelor's degree in a specific field such as business administration, finance, or operations management. USCIS examines the actual duties, not just the title. A COO role at a small startup with generalist duties may face more scrutiny than the same title at a company with a defined executive structure.
How do I find employers actively sponsoring H-1B visas for COO positions?
Search Migrate Mate to browse COO openings filtered by employers with verified H-1B Labor Condition Application filing history. This tells you which companies have sponsored comparable senior roles before, so you're not discovering their willingness to sponsor mid-offer negotiation.
Can a COO be sponsored for an H-1B if the company has never filed before?
Yes, but the employer must file a Labor Condition Application with DOL and then submit Form I-129 with USCIS. First-time sponsors sometimes underestimate the timeline, which runs several months before a start date. Confirm early in negotiations that their legal or HR team understands the process.
What happens to my H-1B status if the company reorganizes or changes my reporting structure after I'm sponsored?
Material changes to your role, such as a significant shift in duties, location, or salary below the LCA-certified wage, require an amended H-1B petition before they take effect. A title change alone may not trigger an amendment, but a change in the actual specialty occupation duties typically does under USCIS guidance.
Does an H-1B for a COO role support a future green card application?
Yes. Most COO-sponsored green card applications proceed through the EB-2 or EB-3 employment-based categories, which require PERM labor certification unless the role qualifies for a National Interest Waiver. The H-1B itself does not confer immigrant intent, but your employer can file a PERM application concurrently while your H-1B remains valid.
