Frame your degree against specialty occupation
USCIS requires your degree to relate directly to the role. A VP Operations petition is stronger when your academic background is in business administration, industrial engineering, or supply chain, not a loosely related field.
Search LCA filings by operations job codes
Use Migrate Mate to filter employers by H-1B Labor Condition Application history for operations management SOC codes. This shows you which companies have actually sponsored similar roles, not just posted them.
Target companies above 25 employees
H-1B-dependent employers face stricter attestation requirements under DOL rules. Companies with fewer than 25 full-time employees in that classification are exempt, but large operations employers are almost always non-dependent and file more freely.
Verify the prevailing wage tier before negotiating
Run your job title and work location through the OFLC Wage Search before your offer conversation. VP Operations roles often fall at wage Level III or IV, and your offer must meet that threshold for the LCA to pass DOL certification.
Request premium processing before your start date
USCIS premium processing guarantees a decision within 15 business days. For VP-level hires with defined onboarding timelines, ask your employer to include Form I-907 in the initial I-129 filing so status delays don't push back your start.
Confirm your O*NET classification before the petition
Your employer's attorney will map your role to an O*NET occupation code. Review the O*NET profile for General and Operations Managers with your future employer to ensure your actual duties align, misalignment is a common RFE trigger for senior operations titles.
H-1B Visa VP Operations: Frequently Asked Questions
Does a VP Operations role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position normally requires at least a bachelor's degree in a specific field like business administration, operations management, or industrial engineering. Generalist executive roles can draw RFEs if the job description doesn't establish a direct connection between the duties and a specific degree field. A well-drafted job requirements section in the petition is critical.
How do I find employers with a real history of sponsoring VP Operations roles on H-1B?
Check DOL Labor Condition Application disclosure data, which shows every H-1B filing by employer, job title, and location. Migrate Mate surfaces this data so you can filter for operations leadership roles specifically, rather than scanning raw government files. Companies with multiple LCA filings for senior operations titles are your strongest targets.
Can a VP Operations H-1B petition be filed as cap-exempt?
Only if the sponsoring employer qualifies for cap exemption, meaning it's a university, nonprofit research organization, or government research entity. Most private-sector employers hiring VP Operations candidates are cap-subject, so the role goes through the annual H-1B lottery. If you're currently in H-1B status with a different employer, a transfer doesn't require a new cap slot.
What happens to my H-1B status if my VP Operations role is eliminated or restructured?
You have a 60-day grace period from your last day of employment to find a new sponsoring employer and have a transfer petition filed. For VP-level roles, that timeline is tight given longer hiring cycles. Starting your job search before a layoff, and targeting companies with active H-1B filing histories, gives you the best chance of bridging status without a gap.
Is a master's degree required to sponsor a VP Operations position on H-1B?
A master's degree isn't required by law, but it strengthens the specialty occupation argument significantly. USCIS looks at whether a bachelor's degree in a specific field is the normal minimum for entry into the occupation. For VP Operations, a bachelor's plus substantial progressive experience in operations is typically sufficient, though the petition must document why the role genuinely requires that degree.
