Verify your role meets specialty occupation standards
Data center construction covers a wide range of titles. USCIS scrutinizes whether your specific role requires a degree in a directly related field, so confirm your job duties and title align with O*NET before applying.
Target hyperscale and colocation general contractors
Large-scale buildout contractors and owner-operators running multi-site programs file H-1Bs most consistently. Search Migrate Mate to filter employers by verified LCA filing history for construction and engineering occupations.
Get your credentials evaluated before the LCA stage
If your degree is from outside the U.S., have a NACES-member credential evaluator confirm it's equivalent to a U.S. bachelor's degree before your employer files the Labor Condition Application with DOL.
Understand prevailing wage tiers for your specific SOC code
Data center construction roles can fall under multiple SOC codes with different wage levels. Use the OFLC Wage Search to look up the prevailing wage for your exact occupation code and work location before negotiating your offer.
Confirm your employer is E-Verify enrolled before accepting an offer
STEM OPT extensions require E-Verify enrollment, and many construction employers aren't enrolled by default. Ask about E-Verify status during the offer stage, not after you've already accepted.
File premium processing if your project start date is fixed
Data center construction projects run on rigid schedules. If your role has a hard mobilization date, ask your employer to file premium processing with USCIS to get a decision within 15 business days and avoid project delays.
H-1B Visa Data Center Construction: Frequently Asked Questions
Do data center construction jobs qualify for H-1B sponsorship?
Yes, but the specific role determines eligibility. USCIS requires that the position normally demands a bachelor's degree or higher in a directly related specialty. Project engineers, MEP engineers, commissioning managers, and technical program managers typically qualify. General site labor, trades supervision without a degree requirement, and broad construction management roles may face more scrutiny.
Which employers in data center construction sponsor H-1B visas?
Hyperscale owner-operators, large-scale general contractors, and MEP engineering firms with active multi-site buildout programs tend to have the most consistent H-1B filing histories. Use Migrate Mate to search by employer and occupation code, filtering for companies with verified LCA filings in construction and engineering roles.
Can I transfer my H-1B to a new data center construction employer mid-project?
Yes. Under H-1B portability rules, you can start working for a new employer as soon as they file a new I-129 petition, without waiting for approval, as long as your current status is valid and you've been in H-1B status for at least 180 days. Confirm the new employer has filed before your last day at the current company.
How does the prevailing wage requirement affect data center construction offers?
Your employer must certify through an LCA that your offered wage meets or exceeds the DOL prevailing wage for your occupation code and work location. Data center construction roles span several SOC codes with different wage levels. The OFLC Wage Search lets you verify the applicable wage tier for your specific title before you negotiate your offer letter.
Does traveling to multiple job sites affect my H-1B status in construction?
Multi-site work is permitted but requires careful LCA management. Your employer must file a separate LCA or an amended I-129 for each metropolitan statistical area where you'll work for more than 90 continuous days. Short-term placement under the H-1B short-term placement rule covers up to 30 days at unlisted locations in a year without a new LCA.
