H-1B Visa Professional Engineer Jobs
Professional Engineer roles qualify as H-1B visa specialty occupations when the position requires a bachelor's degree or higher in engineering. Employers filing H-1B petitions for PE roles must certify prevailing wages through a DOL Labor Condition Application before USCIS adjudicates the petition. State licensure requirements add a layer most applicants don't anticipate.

Verify your PE license transfers across states
H-1B approval is tied to the work location on the petition. If your employer reassigns you to a new state, your PE license may not be valid there. Confirm reciprocity rules before accepting a role with multi-state project exposure.
Check LCA filings by engineering discipline
Employers file LCAs by SOC code, not job title. Look up filings under codes like 17-2051 (civil) or 17-2141 (mechanical) using the OFLC Wage Search to identify which companies actively sponsor engineers in your specific discipline.
Use Migrate Mate to filter verified sponsors
Search Professional Engineer roles on Migrate Mate to see employers with confirmed H-1B LCA filing history in your engineering field. This cuts out companies that list sponsorship as optional but rarely follow through.
Request cap-exempt status through research employers
Universities, nonprofit research institutions, and government-affiliated entities are cap-exempt, meaning your H-1B petition skips the annual lottery entirely. Many civil and structural engineering firms partner with these institutions on public infrastructure contracts.
Align your degree to the offered engineering role
USCIS scrutinizes whether your degree field directly relates to the PE position. A mechanical engineering degree supporting a civil PE role can trigger an RFE. Ask your employer to frame the job description around your specific degree discipline.
Flag EIT credential gaps before the petition is filed
If you're still working toward full PE licensure, confirm your employer understands that Engineer-in-Training status may affect how they describe the role to USCIS. Some states require licensure as a job condition, which complicates the specialty occupation argument.
H-1B Visa Professional Engineer: Frequently Asked Questions
Does a Professional Engineer role qualify as an H-1B specialty occupation?
Yes, PE roles qualify when the position requires at least a bachelor's degree in a specific engineering discipline. USCIS evaluates whether the degree requirement is genuine and tied to the actual job duties. Generic engineering roles where any degree suffices can face RFEs, so the job description should specify the required field precisely.
How does state PE licensure affect my H-1B petition?
State licensure is a separate requirement from H-1B approval, but the two interact. If your role legally requires a PE license in the work state, your employer must account for that in the petition. Relocating to a new state after approval may require amending the petition and verifying your license is valid in the new location.
How do I find employers who actively sponsor H-1B visas for engineers?
Search on Migrate Mate, which surfaces employers with verified H-1B LCA filing history filtered by engineering roles and SOC codes. You can also cross-reference the OFLC Wage Search to see which companies have filed Labor Condition Applications under the specific engineering occupation code matching your discipline.
Can my employer file my H-1B petition if I'm still working toward PE licensure?
Yes, but only if the position doesn't legally require licensure as a condition of employment on day one. If the state mandates a PE license to perform the work, your employer needs to address that in the petition. Some employers list licensure as preferred rather than required to avoid this issue, which may affect how USCIS evaluates specialty occupation status.
What happens to my H-1B status if I switch engineering employers?
You can start work for a new sponsoring employer as soon as they file an H-1B transfer petition, without waiting for approval, under H-1B portability rules. The new employer must file before your current status expires. If you're changing engineering disciplines, USCIS will re-evaluate whether your degree still directly supports the new role.
