Verify your CGFNS credential evaluation early
Hospital HR teams need a CGFNS or equivalent credential evaluation before extending an H-1B offer. Start this process three to six months out, delays here push your entire timeline past the April filing window.
Check NCLEX status before employer conversations
You must hold a valid U.S. RN license in the state where you'll work before USCIS approves your H-1B. Confirm your NCLEX results and state board application are complete before starting employer negotiations.
Target hospitals with cap-exempt or cap-season filing history
Use Migrate Mate to filter ED RN roles by employers with active H-1B LCA filing history, so you focus on hospitals that have sponsored this exact occupation code rather than those who say they'll consider it.
Confirm the offered wage meets DOL prevailing levels
Your employer's LCA must certify a wage at or above the DOL prevailing wage for RNs in your metro area. Cross-check their offer against the OFLC Wage Search before signing, not after.
Ask whether the hospital covers premium processing
Standard H-1B processing runs several months, but USCIS premium processing cuts that to 15 business days. Ask during the offer stage which fees the hospital covers and get the answer in your offer letter.
Understand cap-gap protections if you're on OPT
If you're working as an ED RN on OPT and your employer files an H-1B by April 1, cap-gap rules extend your work authorization through September 30. Don't give notice or pause your shift schedule based on the lottery result alone.
H-1B Visa Emergency Department Registered Nurse: Frequently Asked Questions
Does an Emergency Department RN role qualify as a specialty occupation for H-1B purposes?
Yes. USCIS classifies RN roles as specialty occupations when the position requires at least a Bachelor of Science in Nursing as a minimum entry requirement. ED RN roles typically meet this standard because hospitals routinely require a BSN, and the O*NET profile for registered nurses lists a bachelor's degree as the standard educational requirement for the occupation.
Which hospitals sponsor H-1B visas for ED nurses?
Large health systems and academic medical centers file the most H-1B petitions for RN roles. You can browse ED RN openings filtered by verified H-1B filing history on Migrate Mate, which surfaces employers based on actual DOL Labor Condition Application data rather than self-reported sponsorship claims.
Can I transfer my H-1B to a new hospital if I change ED positions?
Yes, H-1B portability lets you start working for a new employer as soon as the transfer petition is filed with USCIS, without waiting for approval, as long as you've been maintaining valid H-1B status. Your new hospital must file a new LCA and H-1B petition before your first day, so coordinate the timing carefully with both HR departments.
Does my foreign nursing degree count toward the specialty occupation requirement?
It can, but USCIS requires a credential evaluation from an approved organization such as CGFNS to confirm your degree is equivalent to a U.S. BSN. A three-year nursing diploma from some countries may not meet the equivalency threshold without supplemental coursework, so get the evaluation done before you enter offer negotiations.
What happens to my H-1B status if I move from full-time to per diem ED shifts?
Dropping to per diem can create a material change in your employment terms, which requires an amended H-1B petition and an updated LCA. If your hours fall below what was certified in the original petition, your employer must file the amendment before you reduce your schedule, or you risk a gap in lawful status.
