Verify your ECFMG certification before applying
International medical graduates must hold valid ECFMG certification before any employer can file an H-1B petition. Confirm your certification is current and that your medical degree is on file with ECFMG before contacting recruiters.
Target hospitals with GME programs first
Teaching hospitals and academic medical centers run Graduate Medical Education programs and have dedicated immigration counsel on staff. They file H-1B petitions routinely and won't need educating on the process the way a private practice might.
Check DOL prevailing wage before negotiating
Your employer must pay at least the DOL prevailing wage for your OB/GYN role in their specific location. Use the OFLC Wage Search to look up Level I through Level IV wage tiers before you enter salary discussions so you can evaluate any offer accurately.
Search H-1B-filing OB/GYN employers on Migrate Mate
Filter OB/GYN roles on Migrate Mate by verified H-1B LCA filing history to identify employers who have sponsored the occupation before. This cuts out practices that intend to sponsor but have never actually filed.
Clarify H-1B or J-1 waiver paths with each employer
Some health systems prefer Conrad 30 J-1 waiver hires over direct H-1B sponsorship, especially for underserved-area placements. Ask each employer explicitly which path they'll support before investing time in their interview process.
Request premium processing to protect your start date
OB/GYN credentialing with a hospital takes two to four months. If your petition isn't adjudicated before credentialing completes, your employment start date slips. Ask your employer to file with USCIS premium processing to get a decision within 15 business days.
H-1B Visa Obstetrician/Gynecologist: Frequently Asked Questions
Does an OB/GYN role qualify as an H-1B specialty occupation?
Yes. OB/GYN positions require a Doctor of Medicine or Osteopathic Medicine degree plus completion of a four-year accredited residency in obstetrics and gynecology. USCIS treats physician roles as clear specialty occupations because the minimum entry requirement is a specific professional degree, not a general bachelor's degree.
Which types of employers most often sponsor H-1B visas for OB/GYNs?
Academic medical centers, multi-hospital health systems, federally qualified health centers, and large multispecialty groups are the most consistent H-1B sponsors for OB/GYN roles. They have in-house immigration teams or retained immigration counsel and file petitions regularly. Solo or small-group private practices occasionally sponsor but require more vetting on your part. You can filter for employers with verified filing history on Migrate Mate.
Can an OB/GYN on a J-1 waiver switch to H-1B status?
Yes, but timing matters. Conrad 30 J-1 waivers require a three-year service commitment at an approved underserved-area site. Once that obligation is fulfilled, your employer can file an H-1B petition on your behalf. Some employers file the H-1B petition before the waiver period ends so status converts automatically when the obligation is complete.
Does my employer need to file an LCA before my H-1B petition?
Yes. Before filing Form I-129 with USCIS, your employer must obtain a certified Labor Condition Application from DOL. The LCA confirms the position pays at least the prevailing wage for OB/GYN work in that geographic area and that hiring you won't adversely affect similarly employed workers. Certification through DOL's FLAG system typically takes seven business days.
What happens to my H-1B status if my hospital privileges are suspended during adjudication?
H-1B status is tied to your ability to perform the duties listed in the petition. If hospital credentialing is suspended or revoked, you technically can't fulfill the specialty occupation role, which creates a compliance issue. Notify your employer's immigration counsel immediately. They may need to file an amended petition or notify USCIS of a material change in employment conditions before your status is formally affected.
