H-1B Visa Orthodontist Assistant Jobs
Orthodontist assistant roles qualify for H-1B visa sponsorship when the position requires a specialized degree in dental assisting or a related clinical field. Many sponsoring orthodontic practices and DSO groups file LCAs through DOL before petitioning USCIS, making employer selection and timing critical to your job search.

Tips for Finding H-1B Visa Sponsorship as an Orthodontist Assistant
Verify your credential meets specialty occupation
H-1B approval hinges on your role requiring at least a bachelor's degree in a directly related field. Check the O*NET profile for orthodontist assistants to confirm the educational baseline USCIS uses when adjudicating specialty occupation claims.
Target DSO groups over solo practices
Dental service organizations sponsor H-1B petitions far more consistently than independent orthodontists because they have dedicated HR and legal infrastructure. Filter your search to multi-location DSO employers with a documented history of LCA filings on file with DOL.
Search H-1B sponsors by role on Migrate Mate
Pull up Migrate Mate's employer search to filter orthodontic and dental practices that have certified LCAs for clinical assistant roles. You'll see DOL Labor Condition Application history by employer before you apply.
Benchmark your offer against the prevailing wage
Before accepting any offer, run the position through the OFLC Wage Search using the correct SOC code for dental assistants. Your offered wage must meet or exceed the DOL prevailing wage level for your metro area or USCIS will deny the petition.
Clarify who pays which H-1B fees upfront
USCIS prohibits employers from passing mandatory H-1B filing fees onto you. Confirm in writing before signing that your employer covers the I-129 petition fee and any applicable asylum program fee, not just premium processing.
Account for the 60-day grace period when switching jobs
If your sponsoring orthodontic practice closes or terminates your employment, USCIS allows a 60-day grace period to find a new H-1B sponsor and file a transfer petition. Don't wait until the final weeks to begin outreach to new employers.
H-1B Visa Orthodontist Assistant: Frequently Asked Questions
Does an orthodontist assistant role qualify as a specialty occupation for H-1B purposes?
It depends on how the position is defined. USCIS requires that the role normally requires a bachelor's degree or higher in a specific, related field. If your employer's job description requires a degree in dental assisting, dental hygiene, or a closely related clinical discipline, the role can qualify. Practices that list a degree as merely preferred rather than required risk an RFE or denial.
Which employers typically sponsor H-1B visas for orthodontist assistants?
Dental service organizations and multi-location orthodontic group practices are the most consistent H-1B sponsors in this field because they have the administrative capacity to manage DOL and USCIS filings. Solo or small private practices occasionally sponsor but often lack the infrastructure for timely LCA certification and I-129 filing. Migrate Mate lets you filter employers by their DOL LCA filing history for clinical assistant roles.
Can my employer transfer my H-1B if I move to a different orthodontic office location?
A move to a new worksite requires your employer to file an amended H-1B petition with USCIS if the new location is in a different metropolitan statistical area. The employer must also post a new LCA at the new site for the required ten-business-day period before the move. Same-MSA moves within the same employer may qualify for short-distance portability without an amended petition, but your employer's immigration counsel should confirm.
What happens to my H-1B status if the orthodontic practice that sponsored me closes or shuts down?
Your H-1B status ends when your sponsoring employer ceases to operate. USCIS provides a 60-day grace period to secure a new H-1B sponsor and file a transfer petition. During that window you're not authorized to work, but you can remain in the U.S. while the transfer is pending. If 60 days pass without a new petition on file, you'll need to leave or risk being out of status.
How does the DOL prevailing wage requirement affect orthodontist assistant job offers?
Before filing your H-1B petition, your employer must certify a Labor Condition Application with DOL confirming your offered wage meets the prevailing wage for your role and geographic area. You can verify the applicable wage level yourself using the OFLC Wage Search with the dental assistants SOC code. An offer below the prevailing wage will result in LCA rejection before the USCIS petition stage is even reached.
