Target health systems with cap-exempt filing history
Nonprofit hospitals affiliated with universities may qualify as cap-exempt employers, letting you start any time of year without lottery exposure. Confirm the employer's tax status and USCIS cap-exemption eligibility before accepting an offer.
Use Migrate Mate to find H-1B sponsoring employers
Search Migrate Mate to identify employers with verified LCA filing history for supervisory nursing roles. DOL Labor Condition Application data shows which health systems have sponsored similar positions, so you target real opportunities from the start.
Check prevailing wage before negotiating your offer
Your employer must pay the higher of the actual wage or the DOL prevailing wage for your location and role. Run your job title and ZIP code through the OFLC Wage Search before negotiations so you know the floor the LCA must certify.
Prepare a role-specific specialty occupation letter early
Nurse Supervisor positions sometimes draw RFEs questioning whether supervision duties dilute the clinical specialty requirement. Ask your employer to document the degree-level clinical judgment the role demands before the I-129 is drafted, not after an RFE arrives.

Find Nurse Supervisor JobsNurse Supervisor H-1B Visa: Frequently Asked Questions
Does a Nurse Supervisor role qualify as a specialty occupation for H-1B purposes?
Yes, provided the position requires at least a bachelor's degree in nursing as a standard minimum. USCIS scrutinizes supervisory nursing roles more heavily than purely clinical ones because management duties can blur the specialty occupation definition. Your employer's job description should emphasize the clinical decision-making and degree-level judgment required, not just scheduling or administrative oversight.
How do I find employers who sponsor H-1B visas for Nurse Supervisor positions?
Search Migrate Mate to filter employers by verified H-1B LCA filing history for supervisory nursing roles. DOL Labor Condition Application records show which hospitals and health systems have sponsored comparable positions, which is a stronger signal than a job posting that simply mentions visa sponsorship. Focus on large health systems, academic medical centers, and nonprofit hospital networks.
Can my employer file an H-1B for a Nurse Supervisor role at any time, or only during the annual cap season?
Most Nurse Supervisor roles at for-profit employers are cap-subject, meaning your employer must enter the March lottery for an October 1 start. However, nonprofit hospitals affiliated with institutions of higher education or government research organizations may qualify as cap-exempt employers and can file year-round. Confirm your prospective employer's cap-exempt status with USCIS before committing to a timeline.
What nursing credentials does USCIS expect to see with an H-1B petition for a supervisory RN role?
At minimum, USCIS expects a BSN, an active state RN license in the state where you'll work, and an NCLEX passing record. If your nursing degree is from outside the U.S., include a foreign credential evaluation showing equivalency to a U.S. BSN. Some employers also request CGFNS certification for internationally trained nurses, though USCIS doesn't mandate it.
What happens to my H-1B status if I'm promoted from staff RN to Nurse Supervisor after I'm already sponsored?
A promotion to Nurse Supervisor is typically a material change in job duties, which requires your employer to file an amended H-1B petition with USCIS before or shortly after you start the new role. The amendment needs a new LCA reflecting the supervisor job title and prevailing wage level. Working in the supervisory role without an amended petition puts your status at risk.
