H-1B Visa Psychiatric Nurse Jobs
Psychiatric nurses qualify for H-1B visa sponsorship because the role meets the specialty occupation standard: a bachelor's degree in nursing is the minimum entry requirement. Hospitals, community mental health centers, and inpatient psychiatric facilities sponsor H-1B petitions for RNs with behavioral health experience. NCLEX licensure and state RN credentials are required before USCIS will approve the petition.

Get Access To All JobsTips for Finding H-1B Visa Sponsorship as a Psychiatric Nurse
Verify your NCLEX and state license first
USCIS requires an active RN license in the state where you'll work before approving an H-1B for a psychiatric nurse. Get your license transferred or endorsed into the target state before your employer files the petition.
Target inpatient psychiatric units specifically
Inpatient psychiatric hospitals and locked behavioral health units file H-1B petitions more consistently than outpatient clinics. Search Migrate Mate to filter for psychiatric nurse roles at employers with documented H-1B LCA filing history in mental health settings.
Check the prevailing wage before accepting an offer
Your employer must pay the DOL prevailing wage for psychiatric nurses in their specific county. Run the OFLC Wage Search using SOC code 29-1141 before you accept any offer to confirm the wage level matches your experience.
Ask about cap-exempt employer eligibility
Nonprofit hospitals affiliated with a university medical center may qualify as cap-exempt H-1B employers, letting you bypass the annual lottery. Confirm this status directly with HR before the filing window closes in March.
Prepare your specialty occupation documentation carefully
USCIS has issued RFEs on nursing petitions arguing the role doesn't require a bachelor's degree. Request a job description that explicitly lists a BSN as required, not preferred, and include your degree transcripts and CGFNS credentials evaluation with the I-129.
Understand the 60-day grace period when changing jobs
If your H-1B psychiatric nurse position is terminated, you have a 60-day grace period to find a new sponsoring employer and file an H-1B transfer. Your new employer can file a concurrent petition so you can start working immediately upon receipt.
H-1B Visa Psychiatric Nurse: Frequently Asked Questions
Does a psychiatric nurse role qualify as an H-1B specialty occupation?
Yes, psychiatric nursing qualifies because a BSN is the standard minimum requirement for the role and USCIS recognizes registered nursing as a specialty occupation when the position explicitly requires a bachelor's degree. The job description must state the BSN requirement clearly. Roles that list a BSN as preferred rather than required have faced RFEs and should be clarified before filing.
How do I find employers who sponsor H-1B visas for psychiatric nurses?
Migrate Mate filters psychiatric nurse job listings by employers with verified H-1B LCA filing history, so you're only seeing roles where sponsorship is a realistic option. Look for large health systems, VA medical centers, and nonprofit psychiatric hospitals, as these employer types file H-1B petitions for behavioral health RNs most consistently.
Can a psychiatric nurse transfer an H-1B to a new employer?
Yes, H-1B portability under AC21 lets you transfer your petition to a new sponsoring employer after your current I-129 has been pending for at least 180 days or has been approved. The new employer files a concurrent H-1B transfer petition and you can start in the new psychiatric nurse role as soon as USCIS issues a receipt notice.
Does foreign psychiatric nursing experience count toward H-1B eligibility?
Foreign work experience counts toward demonstrating you meet specialty occupation qualifications, but it doesn't substitute for the BSN requirement or an active U.S. RN license. USCIS will review your CGFNS credentials evaluation and foreign transcripts. You must still pass NCLEX and hold a valid state RN license in the state where you'll work before the petition can be approved.
What happens to my H-1B status if my psychiatric unit closes or I'm laid off?
You enter a 60-day grace period from the date of termination to find a new sponsoring employer and file an H-1B transfer or change of status. Working during this grace period is not authorized. Your new psychiatric nurse employer can file concurrently, and you're eligible to start upon receipt of the transfer petition under H-1B portability rules.
