Verify your dental degree meets USCIS standards
A DDS or DMD from a non-U.S. institution must be evaluated for equivalency before your employer files. Get a credential evaluation from a NACES-recognized agency and confirm the report explicitly equates your degree to a U.S. DDS or DMD.
Target hospital systems with cap-exempt status
Academic medical centers and non-profit hospitals affiliated with universities are often cap-exempt, meaning they can file your H-1B petition outside the annual lottery. Prioritizing these employers gives you a faster, more predictable path to authorization.
Search LCA filings to find active sponsors
Use Migrate Mate to filter employer Labor Condition Application data by occupation code for oral surgeons. This shows you which practices and health systems have actively petitioned for this role, so you focus your search on proven sponsors.
Secure state dental licensure before the filing deadline
USCIS requires oral surgeons to hold a valid state dental license at the time of filing. Licensing timelines vary by state and can run three to six months, so start the application process well before your employer needs to submit the I-129.
Confirm the prevailing wage tier your role qualifies for
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your geographic area. Run the OFLC Wage Search using the correct SOC code for oral and maxillofacial surgeons to verify which wage level applies to your specific position.
Negotiate an employment agreement before the I-129 is filed
Your H-1B petition is tied to the employer and position described in the I-129. Lock down your start date, hours, and practice location in a signed offer letter before filing, since material changes after approval can require an amended petition.
H-1B Visa Oral Surgeon: Frequently Asked Questions
Does an oral surgeon role qualify as a specialty occupation for H-1B purposes?
Yes. Oral surgery requires a Doctor of Dental Surgery or Doctor of Dental Medicine degree plus a four-year surgical residency, which meets USCIS's specialty occupation standard. The role's theoretical and practical application of highly specialized dental and surgical knowledge is well-documented in the O*NET profile for the occupation, making RFEs on specialty occupation grounds relatively uncommon for this title.
Which types of employers sponsor H-1B visas for oral surgeons?
Academic medical centers, hospital-based oral surgery departments, Federally Qualified Health Centers, and large multi-site dental service organizations are the most active sponsors. Academic and non-profit hospital employers are often cap-exempt, letting them file year-round. Private solo practices can sponsor H-1B petitions but are subject to the annual cap and lottery. You can browse verified sponsoring employers on Migrate Mate by filtering for oral surgery roles.
Can I work at multiple practice locations on a single H-1B petition?
Only if all locations are listed on the certified LCA and covered by the same employer entity. Each worksite in a different metropolitan statistical area requires a separate LCA certified at the prevailing wage for that region. If your employer wants to add a new location after approval, they must file an amended I-129 and a new LCA before you begin working there.
Do I need a DEA registration and state dental license before my H-1B is approved?
State dental licensure must be in effect at the time the I-129 is filed, not just at your start date. DEA registration to prescribe controlled substances is legally required before you see patients, but USCIS does not mandate it as a condition of petition approval. Build extra time into your timeline because dental licensing boards often take three to six months to process applications from international graduates.
What happens to my H-1B status if my employer sells the practice or changes ownership?
A practice sale or corporate restructuring does not automatically invalidate your H-1B, but your status is tied to the original petitioning employer. If the new entity is a successor-in-interest and assumes all rights and obligations of the original employer, you may continue working. Otherwise, the new employer must file a new H-1B petition on your behalf before your employment transfers. Confirm the structure of the transaction with your employer's immigration counsel before the sale closes.
