Verify your credentials meet H-1B requirements
H-1B eligibility for NP and PA roles hinges on a U.S.-equivalent master's degree and an active, unrestricted state license. If your foreign credentials need evaluation, get a NACES-member credential assessment before applications go out.
Target employers with verified LCA filing history
Use Migrate Mate to filter NP and PA openings by employers who have filed Labor Condition Applications for clinical roles. That filing history signals the employer already knows the H-1B process and isn't learning it on your timeline.
Check prevailing wage before negotiating your offer
Your employer must pay at least the DOL prevailing wage for your role, specialty, and metro area. Run your job title and location through OFLC Wage Search before you counter-offer so you know the floor the LCA must meet.
Understand how your state license affects filing timing
USCIS requires a valid license in the state where you'll practice before approving an H-1B for licensed healthcare roles. If your license is pending, ask whether the employer will file after approval or use premium processing to compress the gap.
Ask about cap-exempt employer status during interviews
Hospitals affiliated with nonprofits or universities may qualify as cap-exempt, meaning your H-1B petition bypasses the annual lottery entirely. Confirm the employer's cap-exempt status directly with their HR or legal team before counting on it.
Request premium processing when your start date is fixed
If a credentialing or employment contract deadline locks your start date, premium processing reduces USCIS adjudication to 15 business days. Clarify in writing whether the employer covers this fee or expects you to.
H-1B Visa Nurse Practitioner Or Physician Assistant: Frequently Asked Questions
Do Nurse Practitioner and Physician Assistant roles qualify as H-1B specialty occupations?
Yes. USCIS consistently classifies NP and PA positions as specialty occupations because they require at minimum a master's degree in a specific clinical field and a state license to practice. You'll need to document both your degree and your active, unrestricted license as part of the I-129 petition. Roles that allow a bachelor's degree alone may face more scrutiny during adjudication.
How do I find NP or PA employers who actively sponsor H-1B visas?
Migrate Mate surfaces NP and PA job listings filtered by employers with documented LCA filing history, so you can focus on health systems and practice groups that have already navigated the H-1B process for clinical hires. Targeting employers with prior filings reduces the risk of stalled sponsorship caused by inexperienced HR teams or reluctant legal counsel.
Does my state license need to be active before my employer files the H-1B petition?
USCIS requires a valid license in the state of intended employment before approving an H-1B for licensed healthcare professionals. If your license is still pending, some employers will wait and file after approval; others use premium processing to shorten the adjudication window to 15 business days and reduce the overlap period. Confirm the employer's approach during the offer stage, not after signing.
Can NP or PA employers skip the H-1B lottery?
Some can. Hospitals and clinics affiliated with nonprofit organizations, universities, or government entities may qualify as cap-exempt employers, which means petitions they file are not subject to the annual H-1B cap or the lottery. Federally qualified health centers and academic medical centers often fall into this category. Always verify cap-exempt status directly with the employer's immigration counsel before factoring it into your timeline.
What is the prevailing wage requirement for H-1B NP and PA roles?
DOL requires your employer to pay at least the prevailing wage for your specific occupation, geographic area, and experience level before the LCA can be certified. You can look up the applicable wage floor using OFLC Wage Search, which breaks down rates by job title and metro area. The LCA your employer files must reflect a salary at or above that figure, so knowing the number before negotiating your offer matters.
