Verify your engineering degree meets specialty occupation
USCIS requires your degree field to directly relate to your engineering role. A mechanical engineering degree supporting a software engineering petition can trigger an RFE. Pull your O*NET occupation profile to confirm the standard education requirement for your specific title before applying.
Check prevailing wage before negotiating your offer
Your employer's LCA must certify a wage at or above the DOL prevailing wage for your engineering title and work location. Run the OFLC Wage Search using your exact SOC code and county to know your floor before salary conversations begin.
Target employers with active LCA filing history
Use Migrate Mate to filter engineering jobs by employers who have filed LCAs for your occupation code. This surfaces companies already familiar with the H-1B process for your specific role, not just those who sponsor broadly.
Flag multi-site project placements early in the offer stage
Engineering roles involving client sites or multi-location deployments require separate LCA filings for each worksite outside the primary location. Raise this with your employer's legal team before signing, since missing worksite LCAs puts your status at risk if USCIS audits.
Time your registration for the cap using your OPT end date
If you're on STEM OPT, the cap-gap rule extends your work authorization through September 30 if your H-1B is selected. Confirm your OPT end date with your DSO before April 1 so you understand your coverage window if processing runs long.
Request premium processing for project-start-sensitive roles
Engineering project timelines often can't absorb a five-to-seven month standard processing wait. Premium processing through USCIS delivers a decision within 15 business days. Negotiate whether the employer covers this fee during the offer stage, not after signing.
H-1B Visa Engineering: Frequently Asked Questions
Do all engineering job titles qualify as a specialty occupation for H-1B purposes?
Most engineering titles qualify because they require at least a bachelor's degree in a specific technical field, which is the core specialty occupation standard. However, generalist titles like 'project engineer' or 'field engineer' can draw scrutiny if the job description doesn't clearly require a specific engineering discipline. Employers should align the job description with O*NET requirements for the relevant SOC code to reduce RFE risk.
What happens if my engineering role requires work at multiple client sites?
Each worksite outside your primary work location requires a separate LCA certified by the DOL before you begin work there. Your employer must also post a notice of the LCA at each location for ten consecutive business days. Short-term placements under 30 days in a year may qualify for a DOL short-term placement exception, but recurring or long-term multi-site assignments require full LCA compliance at every location.
How do I find engineering employers who already have H-1B sponsorship experience?
Migrate Mate filters engineering jobs by employers with verified LCA filing history, so you can identify companies that have already navigated the H-1B process for engineering roles specifically. This matters because an employer sponsoring an H-1B for the first time often underestimates the timeline and cost, which can create delays between your offer and your start date.
Can my employer file my H-1B petition before I finish my engineering degree?
USCIS requires you to have the qualifying degree in hand by the time your H-1B employment begins, which is October 1 for cap-subject petitions. Your employer can file the petition while you're completing your final semester, but you must receive your degree before your start date. Some employers request a conferred degree letter from your university registrar rather than waiting for the physical diploma.
What is the H-1B grace period if my engineering job ends involuntarily?
USCIS provides a 60-day grace period if your H-1B employment ends involuntarily, such as through a layoff. During those 60 days, you can change employers through an H-1B transfer, switch to a different visa status, or begin preparing to depart. The grace period runs from your last day of employment, not from when your employer notifies USCIS, so filing a new petition quickly is critical to maintaining lawful status.
