Map your SOC code before applying
Engineering Team Lead roles can be classified under several SOC codes depending on the discipline. Pull the O*NET profile for your specific track to confirm which code your employer will use when filing the LCA with DOL.
Target employers with cap-exempt filing history
Universities, nonprofit research institutions, and government-affiliated labs can file H-1B petitions year-round outside the annual cap. Use Migrate Mate to filter Engineering Team Lead roles by employers with verified H-1B LCA filing history.
Confirm your prevailing wage tier early
Team lead titles often land at DOL wage Level III or IV, which affects the LCA your employer must certify. Run the OFLC Wage Search for your metro area and job title before accepting an offer to verify the employer's posted salary aligns.
Request concurrent I-140 and H-1B filing
If your employer is also open to sponsoring permanent residence, ask during offer negotiation whether they'll file I-140 alongside the H-1B petition. Locking in a priority date early matters significantly if you're from a backlogged country of birth.
Document dual engineering and management scope
USCIS scrutinizes team lead petitions where the role blends management and hands-on engineering. Make sure your job description clearly states the technical degree requirement and that leadership duties are tied to specialized engineering judgment, not general supervision.
Time your transfer to avoid the 60-day gap
If you're switching employers on an existing H-1B, your new employer must file a transfer petition before your last day. H-1B portability under AC21 lets you start the new role once USCIS receives the petition, but the 60-day grace period closes on your final pay date.
H-1B Visa Engineering Team Lead: Frequently Asked Questions
Does an Engineering Team Lead role qualify as a specialty occupation for H-1B purposes?
Yes, as long as the role requires at least a bachelor's degree in a specific engineering discipline. USCIS requires that the degree be directly related to the job duties, so a team lead overseeing software engineers typically needs a computer science or software engineering background. Hybrid roles mixing engineering and general management face more scrutiny and need detailed job descriptions.
Which employers sponsor H-1B visas for Engineering Team Lead positions?
Technology companies, aerospace and defense contractors, semiconductor manufacturers, and engineering consulting firms are among the most active H-1B sponsors for team lead roles. Migrate Mate lets you search Engineering Team Lead positions filtered by employers with confirmed DOL Labor Condition Application filing history, so you can prioritize companies that have actively sponsored the role.
Can I transfer my H-1B to a new engineering employer if I get a team lead offer?
Yes. Under H-1B portability, you can change employers once the new petition is received by USCIS, without waiting for approval, as long as you're maintaining valid H-1B status and the new role is in a qualifying specialty occupation. Your new employer files a new I-129 petition with a fresh LCA certified by DOL before your start date.
How does the prevailing wage requirement affect H-1B sponsorship for team lead roles?
Engineering Team Lead positions typically fall at DOL wage Level III or Level IV because they involve independent judgment and supervisory responsibility. Your employer's LCA must certify a salary at or above the prevailing wage for that level in your specific metro area. You can verify applicable wage levels using the OFLC Wage Search before finalizing your offer.
Does managing a team affect my H-1B specialty occupation status?
Management duties alone don't disqualify a role, but USCIS looks at whether the position still requires the specialized engineering degree to perform the job. If more than half your duties are general people management with no applied engineering judgment, USCIS may issue an RFE. Job descriptions that tie leadership responsibilities directly to technical decision-making and specialized expertise hold up better during adjudication.
