Document your specialty occupation credentials early
Pull your degree transcripts and any credential evaluations now. USCIS scrutinizes Enterprise Data Architect petitions for degree-to-role alignment, so a transcript showing database systems, data modeling, or enterprise architecture coursework strengthens your specialty occupation case significantly.
Target cap-exempt employers for faster timelines
Universities, nonprofit research institutions, and government-affiliated entities are cap-exempt, meaning your employer can file anytime without waiting for April. Data architecture roles at these organizations are less common but do exist, especially in research computing and academic IT.
Verify the prevailing wage tier before accepting an offer
Your employer must file an LCA certifying your salary meets the DOL prevailing wage for your location and role. Check the OFLC Wage Search using SOC code 15-1243 to confirm your offered salary hits at least Level II before signing anything.
Search LCA filing history by role on Migrate Mate
Filter by occupation code to see which employers have certified LCAs for Enterprise Data Architect roles. This surfaces companies with active sponsorship history, so you're targeting employers already familiar with the filing process rather than convincing someone to start from scratch.
Prepare for RFEs on job duty specificity
USCIS frequently issues Requests for Evidence on data architect petitions questioning whether duties are truly specialty-level. Work with your employer to draft a detailed job description referencing O*NET task categories and specifying the architectural frameworks, cloud platforms, and data governance tools the role requires.
Use the 60-day grace period strategically between roles
If you're changing employers, you have a 60-day grace period after your current H-1B end date. Your new employer can file a concurrent or transfer petition during this window, but avoid starting work until USCIS issues a receipt notice confirming the transfer is in process.
H-1B Visa Enterprise Data Architect: Frequently Asked Questions
Does an Enterprise Data Architect role qualify as a specialty occupation for H-1B purposes?
Yes. Enterprise Data Architect is classified under SOC code 15-1243 and requires at least a bachelor's degree in computer science, information systems, or a directly related field. USCIS evaluates whether the specific job duties demand theoretical and practical application of highly specialized knowledge, so your employer's job description must reflect genuine architectural responsibilities, not generalist IT tasks.
Which employers are most likely to sponsor H-1B visas for Enterprise Data Architects?
Large technology firms, financial institutions, healthcare systems, and consulting companies with dedicated data infrastructure teams have the strongest sponsorship track records for this role. Cap-exempt employers like universities and nonprofit research centers are also worth targeting since they can file outside the lottery window. You can browse verified sponsoring employers on Migrate Mate, filtered specifically for data architecture roles.
How does the H-1B lottery affect my job search timeline as a data architect?
Most private-sector employers are cap-subject, meaning your petition enters the annual lottery with a registration window typically in March and an October 1 start date if selected. This creates a gap of roughly six months from registration to authorization. Plan your job search to land an offer by February so your employer can register in time, or prioritize cap-exempt employers to bypass the lottery entirely.
Can my employer file for H-1B sponsorship if I'm currently on OPT as a data architect?
Yes, and this is one of the most common paths. If your OPT authorization extends through October 1 of the cap year, your employer files an H-1B petition in April and your status converts when the new cap year begins. If your OPT expires before October 1, a STEM OPT extension, if you qualify, can bridge the gap and keep you authorized while your petition is pending.
What documentation should I gather to support my employer's H-1B petition for this role?
Your employer needs your degree transcripts, a credential evaluation if your degree is from outside the U.S., and evidence that your educational background directly relates to data architecture. If you hold a degree in a tangentially related field, gather documentation of progressive work experience and any certifications in enterprise architecture frameworks. USCIS will evaluate the degree-to-duty connection closely for this occupation.
